2004 Infiniti I35 wont shift to OD if it's cold outside

I have a 2004 Infiniti I35 that won't shift from 3rd into OD if it's below 15 degrees outside. I have to drive it for 5 minutes until the tranny fluid gets warm and then it will upshift to OD. The tech at Kennedy Transmission says that this is by design and not fixable. He says that the morons at Infiniti designed it that way to force the engine to warm up faster. Anyone got some information on this? Thanks.

Yes, it has to reach operating temp. This is normal operation.

Or you can warm the car up like a regular person.
