At wits end
At wits end
Hi guys and gals,as title stated..at wits end. For years i been a truck guy. I saw the new nissan maxima an loved it. I purchased an 16 sr black. An i absolutely love the car. No need for details im sure its known. Cannot enjoy. Dealership must of stored car under tree. Spots all over 60% car. Owned car just over month dealership just picked it up again today to repaint car. After two attemps of sanding, bufging who knows what else. Scratches all over paint now. I just want opinions on what to do. Does repainting parts of car devalue it. I purchased new st new car price. Feel as though i no longer have a new car. Please any input would be greatly appreciated.
Are you saying you took delivery of a brand new Max with spots/imperfections all over it, assuming a simple car wash at home would remedy this? Is this what happened? Or did the spots happen after the sale while it was under the care/responsibility of the Dealer for a visit/repair/etc?
I think you should be able to answer your own question. Had the dealer repainted it and it came out perfect, and you were happy, would you be asking this question about value? I think not.
Also take into consideration that you authorized the work though.

The fact that you authorized them to do the paint work, in my opinion, has pretty much left you powerless. You shouldn't have taken delivery of a brand new car in that condition and before authorizing paint work you should have argued for a replacement vehicle. Any time paint work is done to a car I feel as though it decreases the value because most aren't going to believe that it wasn't in an accident.

Let me clarify...i purchased at night...when i put cold water on car to wipe down cause dealership didnt detail car. I noticed spots. Contacted dealership an they said thanks fir bringing to their attention. Had another max parked at same spot at lot that had same marks. Maybe sat for amonths in same spot with tree sap or bird droppings. First time was thier in house details. 3 days had car. 2nd time gave to their auto body shop...13 days. He washed waxed buffed etc. Now today they picked up car to repaint...stains need to be sanded an then painted. Went to an independent body shop an the estimate to fix is close to 5k. This is my dilema...
Also was told by a legal advisor the law states dealership must have car atleast 30days,or 3 different occasions to correct problems with a new car...also if dealership does any work to new vehicle over 500 or 3% i believe of listed price has yo be disclosed. Im starting to feel they knew of this problem annplayed the numbers with me hoping im one of those people who just buys a car an never details it...i purcased new an now i have a new car that needs repainting, not by my own fault.
Repainting will bite you in the a$$ when you go to trade it in or sell it. There is no way that they can make the car not look like it's been repainted. there will be rough edges around the taped off stuff, there will be overspray, there will be other obvious details that will be noted, therefore reducing your residual value at tradin. Because this will be done without an accident or insurance claim, it's possible it will not show up on a carfax, however the dealership may be obligated to report this kind of repair...so again, will devalue the car for resale/trade-in.
Here's what you do, have the dealership negotiate a depreciation buyout, say $2000-$4000 (aim for the highest you can get) and have them not only correct the paint, but pay you for the loss you will incur at trade-in. That's really the only option I can see. Best case, you drive the car for 10 years, pocket the money, and you made out.

I had some similar issues with my black but they detailed it and i knew once that detail was fading out i was going to see all the things they may have been hiding. I took it back for them to wet sand it and buff out some nagging spots and its good for now. I went to a professional detailer to look into some paint correction and ceramic pro or the other one (cant think of the name now) and i will be getting mine done in November. I know that when it is buffed out it looks flawless, so i will have them do the paint correction, buff it good , then seal it with the 9H and add a liitle wet as they call it and i should be good. You have any pics of the issues?
Why would the car be covered in spots. Maybe the hood or trunk but the whole car?
We bought our and 2 days later i scratched the trunk. Then we left it at the airport and someone scratched the bumper.
Shop removed the clear and touched up the spots and put new clear down. $350 in total.
So did they screw up the paint and then slap clear over it? If so thats a real problem. If its just the clear coat then thats an easy fix.

It depends on your state with regard to an insurance claim, but it's known as "Diminished Value" (google that). But in your case it's not too different I suppose. Bottom line, you need to get some information. A before and after appraisal would help. Be sure they are close in time, and be sure the second shows that they observed the repaint, both visually and with a carfax report (this if the dealership reports the repaint). One good place would be CarMax, they give a straight shoot price, and will diminish for you on the second quote, once they discover the repair.
After that, it takes some smooth talking, or a lawyer. But with your ducks in a row, you should be able to angle this into your favor. Trust me, it won't be easy, but stick to your guns, they will likely agree to something monetary, and have you sign a release that you won't pursue additional damages.
