Do I have any recourse

HEy I bought this car from a dealer to later find out a couple days after I had it it head been in a accident before since the paint did not match and it had a new front door and front bumper. To add on to that the car is shaking terribly if I go 55 or above. The dealer wont do anything about it and is just giving me a bunch of crap. I am thinking of suing if it takes that since I feel I was taken. Do any of you think I have any type of recourse

Please help me

did you sign any paperwork with wording like "sold as is" or "no warranty implied or in writing" or anything? Read everything you signed to make absolutely sure the wording can't be interpreted by the dealer to mean "we're not responsible." If so, you're screwed. If not, you have recourse but it'll take a lawyer to get justice.

The car was not sold as is Also by my mechanic I was told that it has a bent engine mount and broken tranmission mount. I hear with this problem it should not have passed inspection. I really think the dealer is in cohots with the inspection station since all his stickers and flyers are at the inspection stations office. Also my mechanic told me the car needed fixing so then I took it to the dealer and his inspection mechanic they said nothing was wrong. Ok I dont think I car should be vibrating you up and down as being normal

You can find a lawyer to represent you for anything, regardless of what you signed. It's just a matter of $$$. Worst case is that you learn a lesson out of this: Take the car you want to buy to YOUR mechanic BEFORE you purchase it.

Yup, that's what I did. Once my mechanic gave me the go ahead on the car, I went back and signed papers. Good luck with this man.

yeah

I did take it to my mechanic he just didnt catch the broken trans moutn and bent motor mount cuz it was kinda of hidden
I just want to get this sob I dont like to be screwed with

I would contact american nissan or better business bureau....both of these place will solve your problem....dealer are suppose to tell you everything that is wrong with car...hope this help.....

That *might* help if it was a Nissan dealer...

I'm pretty sure every state has laws that say it's illegal to sell a car that cannot pass a safety inspection. That's going to be your route to getting this fixed.

Find out if Maryland (that's where you live, right?) has a law that says it's illegal to sell a car that isn't safe (hope yes). Note, this has NOTHING to do with lemon laws in Maryland. Lemon law only applies if the car is less than 15 months old and had less than 15k miles. If Maryland does have such a law, go back to the dealer and show him the law in writing (print it from your state's website for automotive safety) and tell him you'll skip the whole 'lawyer thing' if he just give you your money back.

Now, there are some big 'ifs' here: IF Maryland has such a law and an engine/transmission mount is considered a safety issue... IF the dealer doesn't claim you did the damage since having bought the car... IF a judge (if it gets that far) doesn't just make the dealer fix the damage instead of giving you your money.

Start by presenting the dealer with the facts (law, report on engine/transmission mounts) and tell him (CALMLY) what you want. If he refuses, and expect him to refuse, then contact a lawyer but keep in mind you may end up spending as much on a lawyer as it would cost to fix the car back to "like new."

edit: hey, forgot to mention, you can call your state attorney general for information about the legality of selling a car that won't pass inspection. They can also help you with some ideas about recourse. I live in NH and just discovered a cool law but it doesn't apply to Maryland. Here: http://www.oag.state.md.us/ is the attorney general for Maryland. If I were you I'd just call. I did a quick search on their page and didn't find much about cars with an issue even remotely similar to yours.

Lastly, keep in mind you're probably NOT going to get your money back. So, if the dealer offers to fix the problems, you should probably take the offer. It sucks, but it's also a lesson learned.
