newbie ticket problem
newbie ticket problem
hi everyone
i have a 2k2 max SE. i just wanted to test it one day (i usually go by speed limits..) and just floored it on the palisades parkway from nyc to upstate ny. in the middle of the parkway a cop clocked me going 78 in 50 zone. i pleaded not guilty and requested further deposition (the ticket wasn't "fine ticket", it was "court" ticket.. didn't mention any fine in it). what should I say in court????? help..
Thanks.

are with and ask them how they handle tickets. Do they run a check
with the DMV and increase your rates for tickets? Do they not care
as long as you don't have an accident and don't get your license
revoked? See what will happen there first. When you know the answer
to that, you can decide whether it's worth it to hire a lawyer.
You may want to pose as a person searching for insurance and saying
that you are comparing policy details.
I'm with State Farm and, at least for me, they don't care about
tickets as long as I keep my license (don't go criminal and don't
get suspended for too many points).
(Assuming that you actually did go 78 in a 50...)
If it's *just* a speeding ticket then count yourself lucky - some jurisdictions would give you "Reckless Operation" or equivalent when you exceed the limit by 20.
I don't believe paying a lawyer to represent you at trial will do any better a job of getting you off a speeding ticket than you can yourself. Do a search here and you'll find advice on doing things like filing a discovery motion for the speed measuring equipment (radar/laser) and the officer's certification for it blah blah. In some jurisdictions the officer may not show up, earning you a dismissal - however some places are organised so that all one officer's tickets are heard on the same day of the week so they always show up. Sometimes you'll get a trial by jury (very rare) or trial by judge. In some places you'll sit before an arbitor. You may be able to plea bargain the DA down to a non-moving violation like seatbelt use, but ay 78 in a 50 that's unlikely.
I would go to a lawyer who specialises in traffic cases in your jurisdiction and take advantage of the free consultation. s/he can tell you if it's worth it.
Unless the ticket is over $200, hiring a lawyer and taking a day off work is gonna cost you more. Plus, if your record is otherwise clear and you are older than 18 your insurance should be affected by a single speeding ticket. I'm 27 and have have two speeding ticket in the last 5 years, and my insurance was never affected.

if you want to fight it, get a lawyer, if you spend the money a good lawyer can get you off almost for sure

Palisades probably = NY State Trooper. I'm not sure but probably the dude is lucky it wasn't in NJ that he was stopped. Be prepared to get socked with the points and hefty fine and higher insurance. If a NYS driver, take defensive driving to nullify the points. In many cases without the defandant opening his mouth the justice will offer something less--if not taken, go to trial and waste both time and $$$.

Yup. NYS trooper. Do you know where the second rest area is? the one in the middle with gas station after NJ-NY state line Northbound. he was hiding there and that's where he catched me. I'm a MA driver. What would happen if I get reckless driving? How much do you think the fine would be? (an estimate). Would I get my license suspended?

Can't really argue it when you're doing close to 30 over the limit. Being a MA driver may help though. Some insurance companies don't care what you do in other states.
Good luck.
