Thank God no one's hurt, even the genetic mistake that ran into you. Good luck with the insurance money.

Glad to hear you're ok. As long as you're not hurt...at least a car is replacable.

But why is it that it's always careless driver's that don't have insurance. When I got rearended 2 months ago, the guy didn't have insurance or a license. So my insurance had to take care of it, and they're taking him to court also.

I'm gonna try and stay Maxima, but it doesn't look good right now. I only work 19 hours a week because I am in school full time, so getting a loan will be really hard. As far as parting out the car, I still owe $11k, so if the insurance pays it off, they will want to keep everything, but I'm gonna pull on the aftermarket parts that I can. Who should I talk to about sueing this guy?

I'm serious, man - try Navy Federal - they hooked me up 3 years ago when I didn't even have a job - flat 7% on the loan for a used car - you could get a 97 5-speed with reasonable mileage for the 11k you already had to pay off anyway.

- and I'm only a dependant - with your service record, you're a shoe in. - it's worth a try at least. I'll drive to Silverdale with you to start the $5 saving account that's required.

You just say how much you want for the loan and they cut you a check. That means you can go into the dealership with cash, which gives you more negotiating power.

As far a suing the guy, call around the yellow pages and just talk to a lawyer - they'll tell you your options 99% of the time over the phone, no charge.

Also, go see a doctor!

The thing with suing the guy is that if he doesn't have any money, which he most likely does not, then you don't collect anything. When you win the judgement, there's not a whole lot the court can do to enforce it if he's broke.

sorry to hear it bro

and yea.. if the guy is broke there is nothing you can get out of him

I would guess the best thing to do is turn your car back to stock ASAP and buy another Maxima hehe if not, just stay around the board and let us know what are your plans

its only a car (a nice one and quick too ) but you're ok, hope this wont cause you too many problems- accidents just screw up your day your week and sometimes your month...
I know how it is...

glad to know you're ok..

As i've said many times in other situations..make that Ford owner put his kids into prostitution if it means getting back to you what's owed. Ok maybe not, but if he has a home, can't he refinance and use that money to pay you... or like can't you get collections on him or something. Make that motorist scum donate sperm for life til he's paid you in full!

Go with the Navy Fed idea...i've heard that they're really good about it. Try finding a salveged 97 or 98 and get the carfax details first. It shouldn't be so bad.

They should execute people with no insurance.

Show it on pay per view to make up for the lost funds.

wow, your accident sounds almost IDENTICAL to mine 3 months ago where my first maxima was totaled. The b*tch made a left turn and i swirved out the way but she didn't stop and hit me at my back door causing me to spin into traffic light....

good thing u were fully covered. Otherwise i would have tried to sue that bast@rd for a new car along with payments on old car.

i'll be watching for your parts 4 sale...

Update!!!

Well, as expected, the car was declared a total loss... after my deductable, they are giving me $10,600 for the car... I still owe $11,600 on it, which means I'm out another $1000 and have no extra money for a new car... I'm sooooo freakin screwed right now.... gonna have to drop outa school and go back working full time...

I agree with jeff. you don't have to except there first offer, they will always try and get away with the min possible. dink with them for a little bit. besides that will give you a little more time to switch stuff on the car.

Re: Re: Update!!!

Well they came up with a total of $11,200, and from looking around these past couple days, that seems about right... minus the $500 deductable and that's what Ive got...

Re: Re: Re: Update!!!

Matt, I urge you to find some retail ads for some local or regional maximas that are advertised for more and resubit those for negotiations. Also make sure to note any recent work/tune ups/suspension/tires/wheels/etc... that you did. If you got aftermarket shocks, just say "new shocks" and put a purchase plus install price etc....

When I totalled my Merkur XR4TI, they lowballed me @$4000. I submitted ads and all the recent work I did and got another $500. Not bad.

Besides, what does it hurt to try?

see about what they'll offer you to be able to keep the car. Didn't meccanoble keep his and then parted it out? im sure theres more than enough org members that need some stock parts.

but that suggestion is only if you have the time and the money.

Well tonight Iansw and I went and raped my car. I took off everything I could, and Ian has some new brakes now. The suspension (H&R/AGX) was still in perfect condition, but no one showed up with stock stuff to swap out so I guess it's going to the salvage yard like that. I got a bunch of photos I'll post up when I have time. The crank pulley was shattered...
