My brother in law was a King County policeman (Seattle).

I was in the car with him when he gave 2 tickets for wreckless driving to people who were street racing in his neighborhood.

They fought the tickets, and they lost.

The Judge apparently said cops can give tickets anytime, anyplace, for anything, as long as they witnessed a crime in progress.

(I didn't go to court, but only asked him about it later)

okay whatever. If it's really seriously not fair, then logoff and do something about it. Fight the cop, and try to reason with your parents for why they shouldn't take your car away.

But you are not painting a very favorable, nor believeable picture of yourself.

When I had my junior license at 16, being out past the 10 or 11pm curfew would **NOT** get your license taken away. You would most likely get a warning, or a small ticket, but you would NOT have your license taken away or suspended.

Even if the laws in your state would allow your license to get suspended for something as stupid as that, you YOURSELF would have had to have been doing something stupid to get pulled over and have your license taken away in the first place!

I drove past curfew more than a few times, and never got pulled over. Even drove past cops sometimes. Don't give cops a reason to pull you over and you won't get pulled over. Period.

Seriously, I knew what he was talking about. I knew his parents had taken it away because they are so bloodsucking (no offense but you probably feel the same) that they would actually do such a thing...and actually set you up. I believe it because parents are fukced up to 16 year-olds like that. Your parents get better when you learn all the laws and point out all their crap. You should do that since you're probably gonna drive along with them for a long time. Bug them about not making complete stops, or even not stopping at stop signs for the right amount of time.

FYI in CA we were told at traffic school that you can get a ticket for reckless driving or maybe running a red light (can't remember) if you proceed from a stop on a green light without waiting for 3 seconds after it turned green.

Unfortunately ian is right. Off-duty cops can give you tickets, and even parking enforcement can give you a speeding ticket, but they cannot follow you. Hell, even normal citizens can give you tickets. They have to get your plates and call it in and in a citizen's case, witnesses go a long way. Now in ian's bro-in-law situation, the violators were doing something hella illegal (street racing). You were avoiding an accident, or as you can say in court "driving with an attempt to preserve life." Oh and judges just love to screw around with teenagers in the courtroom. They'll bring up your parents a lot and a hick VA judge will most likely tell you to shut up all the time.

Honestly, i wouldn't fight the ticket. But in the meantime, find where the car was taken to... make a copy of the key... get some buddies and steal it overnight... sell everything here on the .org (i'll buy both rear passenger doors)... and put that into savings or something til you have enough to get yourself a used or possibly salvaged but non-lemon 95 5spd for around $4-5k.Oh, and let your parents read this thread.

Sorry to hear this happend, but an officer CAN give you a ticket off duty. the way u explained tho, it seems like you were being harassed. i would definitely fight it, you have nothing to lose.

Hey...show a little love for a fellow org member. Not everything everyone posts on here is lies. My parents used to pull stuff like that all the time (though they never sold my car...)

Seriously though, find a job that you can take a bus or something to, screw them and buy yourself another set of wheels. Then be really careful for years and years and years so you don't get pulled over ever again.

Also, you should put your parents' car on Ebay, lol.

I feel bad about what happened, but I'm not going to give you sympathy. You have to get over it - keep hanging out on these boards, and when time comes to buy a new car you will know exactly what and maybe even where to get it.

I just got off the phone with State and Chesapeake police departments, and neither of the officers whom I would need to talk to regarding an off-duty ticket were there. But the operator or State Police was fairly condident it was NOT possible, and that at most he could call another on-duty officer to ticket you. So it seems like it was set up.

But don't get down bro. Find another job, a closer one if possible, or get somebody to drive you there. Work as much as you can, and one of two things will happen. One, eventually you will have enough money for a car. Or two, as I would expect any parent to do, your parents will realized how hard you're working and how badly you want a car, and get you one (or yours back). You parents could always just be loaning it to their friend, so you think she's bought it.

And I know the pain. Today I got my first ticket, 19MpH over the limit. My parents aren't really mad, but I am. I am ****ed that I didn't notice how badly I was speeding. The officer was nice and friendly in my case, as were my parents, but I STILL feel like sh*t.

The moral being, don't change you lifestyle just because of this. From what you said, you have a STRONG court case. You avoided an accident at any cost, and got away safely. Tell your parents that, and don't plead with them. You TELL them how it is. Cops get power-trips. You avoided an accident. Your parents don't understand it and they are being head-strong. Life's tough, but don't get lost. I'm still up to meet ya when you can.

Whether you own one or not, you're a Maxima-lover for life. And you know that.

I've decided to add my 2 cents to the conversation...

#1 ANY PERSON, officer or not has arrest powers if they see a crime committed. A police officer is, technically, never off-duty. Officers are "compelled" by law to enforce laws, even when off-duty, so that part is not going to help you in court.

#2 I'm not believing everything about your story either. Parents can be a$$holes, but for everything to happen that you say happened, surely there's more to the story. Are you POSITIVE that maybe you weren't going just a little over the limit? Or that maybe when the "old man in the minivan" pulled out, you weren't just trying to make an issue out of it and purposely sped up and passed him in a no-passing area?

#3 If you have any sense at all... DO NOT pull any of the stupid **** that some of the idiots here are telling you. Otherwise, you won't even need a car until you get out of juvi when you turn 21! Hahaha! Seriously though, to me, it seems that your best course of action might be to go down to the police precint, find the officer, explain to him how the events of that traffic incident have affected you, and apologize to him. Like my grandmother used to say, "You'll catch more flies with honey than you will with vinegar."

#4 Slow down. There's plenty of times and places to go fast in life. Wait for 'em and be responsible.

Holy crap! That may be the dumbest thing I've ever heard of! No offense, but:

1) Your dad is a lying ****. No way he could have sold the car that fast, unless he was planning on it. Also, what kind of parent would say "you can't get a job" - my parents are practically begging me to get a job as of right now (6 months till college )

2) That police officer is absolutely rotten. Its been stated that he was off duty etc, but what cop gives a ticket when someone makes a smart driving decision, even if it is illegal?

(this one doesnt involve offense)

3) You're a pretty cool guy. How do I know? Well first of all my computer would be smashed so I wouldn't be able to post on the .org in any case, and I probably would have punched my dad (especially about the work thing AND that hes not giving you your money). I feel like you: I have my max, my bass and a handful of friends. Trust me, it'll be OK. And you have thousands of maximanacs right here to console you.

Anyway, not that it matters or that it should matter, but I personally believe this to be a ficticious tale. In the event this is actually what some 16yr old young man is going through, then we should all go to our place of worship tomorrow and offer a prayer on his behalf because that's pretty damn dysfunctional (as compared to other upper middle class dysfuncionalities).

I've written out a conversation you should have with your parents:

You: "Mom, Dad, can we talk?"
Parents: "Well..is it something worth our time?"
You: "Well, it concerns my future and my relationship with you guys"
Parents: sigh "lets hear it then..if we have to..."
You: "Mom..Dad...umm..can you lay the f*ck off my nuts? the two of you are all up in my sac. ease up offa my shiz yo"

I feel with a well planned conversation such as this one, you shall instanstanly command the respect you desire from your parents.

I'm really sorry to hear that... just cuz you're car is gone now, doesn't mean you have to quit the ORG. Who knows, stick around, stay current, and when you do save up that money, you can get your very own maxima

I know how hardcore parents can be.. i guess im fortunate to have not as hardcore as yours (however u wanna say that) but there are always gonna be something about every parent that's gonna drive u nuts.... like w/ my dad, he doesn't approve of my gf whom i've been with for 2 years because he doesn't like her mom. He's the only reason as of now that's keeping her from becomin my fiance... but w/ enough time i'd just be like **** it and him if he doesn't wanna be happy for me.. whoa sorry this thread just reminded me of my parent situation and this came out. anyways enough venting, There's ALWAYS something so stupid and makes u wanna bang ure head against the wall!

Find the police officer and explain him the situation. Use any money you have saved to contact a lawyer and see where you stand with the law. Tell you parents not to sell the car until the charges are dropped against you. It looks like they have been planning this for a while now. If they still go ahead and sell it. I can only tell you to make the car undrivable, whether you want to pull some wires, add some water in the gas tank its all up to you. Good luck.

This is not completely true...while they are "compelled" by the law to enforce said laws, this only applies to FELONIES when they are off duty. Neither speeding nor wreckless driving is a felony..they are both misdemeanors..thus an off duty officer CANNOT issue a citation for such an offense.

I for one think it's pretty pathetic that a bunch of you possibly spoiled (now or in the past) kids (whether you're 16 or 30) actually believe this kind of stuff doesn't happen. I hope to God that a lot of you that are calling this BS are doing it just for laughs, because schit like this DOES happen. Even if this guy's tale is ficticious in the end, for some of you to think that a parent won't do this or maybe even worse things is sheer ignorance. So all parents are perfect because they're old and wise, right?

Some families hold on to traditional customs no matter how whack they may be to us modern folk with "good" families. You don't brush your teeth...here comes the belt. If you're a girl, you go out with a boy behind daddy's back, then you have 2 black eyes in the morning.

Taking his car away is a mere slap in the wrist for what his parents could've done considering what they actually know (all they know is that he had a run-in with the law). He should talk to his parents, but some are too hardcore to not listen and that's just the way it is. If you're not 18 or 21 then you're not wise enough to vote, or judgmental enough to drink or smoke, or even smart enough to reason with your parents. That was my case when I was 16, and I turned 18 and had a talk with my parents and they ask forgiveness for thinking i was just being a rebellious punk. Not all of us are rebellious punks.

For lack of a better known example: So if his parents sell his car for a stupid reason, you guys are telling me that if your parents make you work to help them out by giving them your paychecks for rent, then there's no way they can kick you out after you front the money? So someone like Eminem is bull****ting because there's no way his hick mom could've done such a thing to him? Sorry for that example but it's a more recognizable one.

Not everyone's parents are the same, and yes let's pray for him because there's a lot that can be done about communication.

Everything is fine until: im on my way back to work , and this minivan pulls out right in front of me and I am about to hit it. SO i took the turning lane and went around him. SO i get back to work nervous as hell and a guy meets me at the front door. He's like hi young man are you the one driving the MAXIMA i was like yes sir. He was like im officer **** and i was in the minivan. Blah Blah Blah you kno the routine he asks me for my licence. Then he calls my house and talks to my dad. And asks my dad if he should give me a ticket, my dad said no. But that SOB still wrote me a ticket for wreckless driving, when all i was trying to do is avoid an accident. SO i get home. Talk to my dad and My BABY has already been SOLD. In addition i have to quit my job and all this other bogus BS. Well guys ill still read threads from time to time but no more maxima enthusiast. OH and by the way the best part i paid a few grand cash for my 1995 max but i dont get any of it back. Thanks guys, it has been nice

And in closing Charcoal95GXE, someone said it best when they said to just save up your dough, get yourself another Max, while keeping up-to-date on stuff here, and don't stress about it. You'll be fine.

I ended up NOT[B] getting the wreckless driving ticket, I guess what happened is when my dad talked to the cop they decided not to give me a ticket, but my parents were still ****ed. You guys were right my car had not been sold yet , but http://cgi.ebay.com/ebaymotors/ws/eB...874460983&rd=1

whos car is it? if you put money in to buy it you should get that money back when they sell the car, its only fair just cause your 16 doesnt mean you cant stand up for yourself.
just my .02

btw this is why I have bought both of my cars on my own and have my insurance in my name, cant nobody hold me down. but it seems like my parents are way more understanding than yours.

I guess he must have launched it before.

Also find it funny that you didn't think about creating a fake ebay name and bidding the sh*t outta the car so that no one wins. Or even asking a few of the guys here to help you out on that aspect.
