Looking for assistance from a lawyer or knowledgable person
Tomorrow is my traffic hearing for my 28-701A failure to control speed of vehicle to avoid a collision. Driving down the roadway when a car came into my lane at a much lesser speed right in front of me, cutting me off, and causing me to swerve around the car. Only problem is that when I recovered from the swerve I was in a turning lane which was ending in just a few feet. Needless to say I went up over a curb, plowing through a stop sign and ultimately ending up demolishing a power transformer.
If I'm found guilty of my speed being unreasonably fast, although I was NOT speeding, I will also be charged with a 28-3321 which means I will lose my license for 3 months. Any help is appreciated. What are the odds that the cop will show up?
28-701
28-3321
The only thing I can find as a savior in 28-701 is that a car coming from off the roadway and into my lane at a slower than reasonable speed (car was probably going 15-20mph) is an obstruction that is not considered a 'potential hazard' because no one drives around thinking (what if a car was parked in front of me up here...) and that the other car did not practice the 'duty of all persons to exercise reasonable care for the protection of others.'
The greatest part is I can name 7 statutes that the other car broke, yet he's off no problem since I didn't get his plate as I was recovering my vehicle, and the fact that I didn't hit him...
Any good help or knowledge is appreciated!!!
