question about court hearing date
whats up guys?? i have a 90 maxima and live in new york city. im just wondering if any of you can help me out here with some helpful info. here's the story, i got a speeding ticket last year ( 73 in a 50) so thats 6 points. i just got one over a week ago for doing 65 in a 35 - another 6 points, which would mean my license is suspended (possibly revoked, im not really sure how it works). i pleaded not guilty because there is no sign that says speed limit 35, there only signs that are posted are later on which say speed limit 50. I took pictures and plan on bringing them to court as evidence. Do you guys think i have an honest shot of winning this case?
Also - I sent the Not Guilty Plea in last Thursday up to Albany, I was just wondering if any of you would know how long it generally takes to get a notice back in the mail with the court hearing date, and when the date would be (just a rough estimate from the time i mailed the plea) The reason im asking is because i am suppose to be out of town for a week around March 10 to 17. If any of you know for sure if the hearing would definately be before, around that time im out of town, or after i come back i'd greatly appreciate. Also, if the hearing is unfortunately during the time i am out of town, do i have the opportunity to postpone the hearing? Thanks a lot guys!

there wasnt one. this was on the bronx river parkway. I was coming up a ramp and onto the highway ( the highway begins here with two ramps joining up into one and forming a 3-lane highway) and there is about a quarter mile from when the ramp ends (highway begins) and the speed limit 50 sign. so i just assumed that quarter-mile stretch was also 50, not 35.
Well each state has a SET speed limit to certain areas where speed limits aren't posted. Here in Chicago, unless posted otherwise, the speed limit is 30mph. I really doubt you have any chance of winning and that other ticket won't help either.

its 30 mph here also in nyc
id plead guilty and pray they dont take your liscense. even if the limit was 50mph you were still way over that anyway 65 in a 50 is still 15mph over IF the limit was 50 instead of 35.
how old are you? here in TN as a minor they will yank your liscense for a period of time for almost any ticket

in NYC, it takes forever for them to process the tickets.
I got 2 tickets at one time and my 1st court apperance was scheduled 3 months after i sent it in. Then I post poned it twice and the 3rd time the cop did not show up.. All in all.. i finally faced the judge and got a judgement in my favor after almost 11 months after the violation. But this was due to an error the cop made on the ticket. Reason I postponed is that i was told some cops do not show up to old violations and do not keep their notse from back then so they may just skip out on the hearing and the judge will dismiss the tickets. But when the cop did not show up, the judge just post poned my date again.. but said if the officer would not attend the next time, it would be dismissed.
You should consult with a lawyer.. because you are on the edge of losing your license, a lawyer may be able to plea down to no points or something..
Another thing.. go take the defensive driving 6 hour lecture course.. it deducts 2-4 points from your license and gives you a 10% break on your insurance rates..
Do this just so you can keep your license, so if/when you receive the next 6 points, you will only have 10 at most (depends on how much the course deducts, i don't remember exact # but it's at least 2 points). This will allow you to keep your license. After that, just take extra caution driivng, do not speed.. this will be your last chance before they take it away.. drive careful until at least the 1st 6 points dissappear from your license..

thanks a lot nyce maxima. i appreciate your input. i actually called up the dmv today and finally got through (i tried before, its usually impossible to get through here in nyc) the lady told me the same thing you said, they're so backed up in albany it may take weeks or months before they set up a court date. and ive heard if the cop doesnt show up they dismiss the case right there and then, so im just crossing my fingers and hoping all good comes out of it.
