great... tranny issues again

Quick history on my car...

I had my tranny rebuilt at 151k miles last year during mid-july. About 10 months later, I just experienced a problem that I think is tranny related.

I was going up a bridge in 3rd gear and about 2k RPM, the power just dropped... lagged or it felt I was midway into the clutch or something... I shifted out of it and I skipped up to 4th gear. I stopped at the light and then continued... I got to 3rd gear and it felt fine. I started from low RPM in 3rd and gunned it. It picked up fine, no issues. I was driving on the freeway for about 30 min in 5th gear previous to this incident.

Well, I am home now and found the receipt from the rebuild. I got my tranny rebuilt because I was leaking tranny fluid and had bad bearings. They replaced a couple of bearings and 3rd and 4th gear i think.

damn, I think i'm SOL. The warranty lasts for 1 year or 12000 miles. I have driven 12563 miles. I'm not sure what this issue could be. I'd like to go to the guy and tlel him to cover it under warranty, but I had issues with him before and swore never to back to him. He'd always keep my car for days and junk when I took it back for warranty repairs earlier.
