Nearly had an accident because of Nissan Service Dept...

You may be wondering how that could be so I'll explain the situation. About a month ago, I had the Clutch and Brake TSB's done on my 02 by Nissan in Marlboro MA. I had the clutch howling noise and brake shudder. The car was under warranty so it was all covered.

On Sunday, I was heading to visit my family for Easter and I was on I-495 heading to I-95. I was in the middle lane and started moving into the right lane to take the exit ramp. As soon as I touched the brakes to slow down there was a loud crunch sound, I lost steering, the brakes tensed up and the engine died. I was able to steer into the exit ramp then the car went straight off the curb into the dirt area.

I started the car right up and tried to move, and the car wouldnt budge. It just died like there was something stopping the car from moving. I got out and looked at a 30-foot skidmark my car made from the highway to where I stopped. Turns out that the front driver-side brake caliper AND retainer basically FELL OFF the hub and rotor. It hit the inside of the rim and scraped it up so badly the there was a ball off aluminum that blocked the wheel from moving.

Luckily I had AAA and called them. That turned into a nightmare since It took 3hours to get my car towed by a flatbed back to Marlboro Nissan which was 50 Miles away. I went to the dealership and talked to the service manager and explained what happened and showed him the car, also telling him that his service department was the last to touch the brakes. Needless to say I was heated.

I told him I wanted a rental until he fixes my car. Right now it seems like I'm going to have to wait till Friday to get my car back. I think that any of you who get safety work done should make sure the service department triple-checks the car for you!

Holy carp Clark!! Glad you're ok....

Did they simply not tighten the lugs on the wheels?

I just had my max at marlboro nissan on tuesday......will check it today!!

Thanks Buddy! No, the wheels were fine, the bolts holding the brake itself was not tightened so the bolt fell out. I have also seen 2 5th gens there this week. A Modded charcoal 00 or 01 with exhaust, rims, AE interior and suspension. And another one gold with rims and clears. Wondering who's they are since I haven't seen them before.

Damn, glad your ok. The nissan dealership i bought my car from messed up and decided not put a clamp back on something when fixing my A/C. Needless to say the car overheated and the whole radiator blew. It took 3 hours to get towed, luckily they fixed it all the next morning.

Pure incompetence is guaranteed when you visit your local Nissan service department.

After visiting ALL BRANDS NISSAN in HACKENSACK NJ to fix my broken trunk latch, they gave my car back to me with the new latch installed and my trunk misaligned. I should have known that Nissan would screw something this simple up.

OMG, that is frightening, I would be a bit shaken after discovering it. I wouldn't blame you being heated about it. It's a good thing that they are fixing and replacing it since they are responsible for the work.

Glad to hear you and the car are okay Clark. Damn dealership can cause someone to get hurt bad if they don't double check their work.

That is why it is always better to do jobs yourself if possible.

Once, Nissan didn't tighten the return hose when I have the Tranny flid changed and when I got home fluid was leaking out all over the place.

Yes it could have been much worse. What do you guys think about me asking for them to give me an extended warranty for the mistake? They have already lost their credibility with the quality of their service. Do you think that is reasonable?

Also, I posted a few months ago that I want a car that was more reliable than my 3rd gen. Apparently this is a lesson that a car is only as reliable as the ones who work on it.

Its all about getting to know the techs. I know most of them here by name. I have gone to the track with 2. So they are much more personal with my car. They don't bang wrenches all over the place in the engine bay like they do with other cars. Also, whenever the max is in a bay getting worked on, I'm usually watching and chatting with whoevers doing the work. I know it may get anoying sometimes but I'm keeping everything in check. If you do this you will have a well cared for vehicle. It has also given me a good relationship with the manager and in the next week I might be Nissans newest oil change boy. I know its menial work but...ohwell. Its my foot in the door.

Come to think of it - you should consult a lawyer. You may be able to make Nissan pay for being careless.

Perhaps you could be driving an M5 in the near future.

First, make sure that when you pick up your car that the repair invoice comments state EXACTLY what your complaint was, and EXACTLY what the cause of that problem was (make sure that they admit fault in writing). By doing this, you will have written proof, as well as the fact that it will remain in their computers for Nissan see. If possible get pictures of damaged parts, they are obligated by Nissan to hold warranty replacement parts for a period of time, usually 1 month.

Next contact Nissan Customer Relations (phone # should be in your owner's manual), tell them what happened and they should be willing to do something for you (possibly extend your base warranty 1 year or something similar).

I get my car back today. They replaced my axle, spindle hub, brake rotor/pads/calipers, the messed up rim and gave me 4 new tires. We'll see how things turn out. I will give nissan a call and see what they tell me anyway. But it seems like the service department made good with the whole thing by replacing it all and also fixing a dent on my fender from them too.

If they dented my car anywhere and coulnd't return it to absolutely perfect I'd be demanding for new paint in that area. Looks like you made out of this pretty well - the danger you were put in. How worn were your tires?

I think they've done enough to try to fix their mistake. it's an honest mistake, and that's all they shoudl really be expected to do to rectify the problem. yeah, forgetting to tighten two bolts can be a pretty scary thing, but there's not a single person on this forum that hasn't forgotten to do the same at one time or another.

there's no reason to get sue happy on them when nothing serious happend. coulda woulda shoulda doesn't count once it's already done. Sure.. go ahead and sue them for killing you, three other cars full of passengers, material damages of about $1MM, pain and suffering for the survivors, and etc etc.. their lawyers will have a heyday with you.

don't be stupid guys. nissan made a mistake and they fixed it. move on. just because everyone else in the world thinks they can sue for BS stuff like this does NOT mean that it's acceptable.

I would sue the **** out of them... Brakes is not something to play with, if he died how would he sue? he's lucky he got out of it alive it could of been much worse..

They did do right, fixing everything they broke plus 4 new tires... They know there in the wrong and are obviously babying him so he doesn't get sue happy... Either way glad your okay and got out of that situation 4 tires richer and in good health.

They seem to have made good on their mistake. If he tried to sue after that, he could lose in court and be countersued for court costs by the corporate lawyers. No need to milk them for anything above and beyond.

Hey Matt! well spoken my friend. Well, I don't plan on sueing them, and I didnt plan to in the first place. They are local to me, the dealer is 1 mile away from me and I've been going there since I had my VG. So I am definitely a familiar face there and have good relationships with some of the folks there. They did make good with their mistake. I am satisfied at this point. I needed an alignment, balancing and tires. All of which they did for me. I got a new set of brakes so, I doubt they can make that misktake again. Not to mention they gave me a rental for the entire time the car was getting fixed. I had some fun in a 2004 Mazda 6.

I got my car back on Friday, and they made the car as good as new. I've got new tires which alone I am happy with. I was close to spending a ton of $$ on tires anyway. My fender looks perfect, all I need to worry about is the scrape on the rear bumper from a hit and run
