Funny dealer story (long, once again)

Funny dealer story (long, once again)

We got home yesterday to a message from the dealer asking us to come in and correct our purchase contract. The dealership made our 1st payment 90 days after signing. Since we bought it March 24th our first payment, according to the dealer, was to be April 24th but the contract says June 24th.

Since we haven't purchased from this dealer or had any car payments in years we assumed this was the way the dealer did business so we ignored it when we signed.

I have had just enough contract law to be dangerous and I simply called the dealership and in a calm tone said I was perfectly satisfied with our current valid contract and had no desire in signing a new one unless we got additional consideration.
When he balked and said Nissan would reject the contract I said that's fine, we can return the Maxima and they can give us the VW or how much it would cost to purchase a similar car at a retail price. Basically put us in the same position as if the contract had never happened.

I told him to call Nissan in Dallas and see what they want to do. I really don't care maybe this is a sign to get the G35 coupe instead.

I knew they had already sold our trade-in(Passat)so they wouln't be able to give us the car, just ca$h. I won't want all those problems back anyway.

Mistake

So basically what they should have done is said, "Mr.& Mrs. Abcd, we made a mistake we would like a oportunity to go over this with you to and come to a mutual agreement." But as usual sales will (I know, work in serv.) try and back door ya on these "mistakes" even when they really are.

Just went through a similar situation. Purchased a '00 Villager (Quest clone) for my wife, trading in a '98 Quest. Dealership called me back in and said the bank was pushing back and wanted a 2k down payment (this was after they had simply asked me back to sign a couple of papers...pi$$ed me off when I found out they lied to me). We told them to take the van back (after we had put over 1k miles on it in 1.5 weeks).

End result: We put $500 down, the dealership gave us $2400 additional on trade in. Payments are basically the same, but, there are now 6 less payments than the origional contract.

Worked out better for us....Still won't work with that dealer again.
