ok, .... tonight SUCKED. my boys from michigan drove 5 hours to come visit (they used to live here..).. they have a modified contour svt , rims, exhaust, lower, bodykit, etc (ypipe, intake, maf,..) etc.. you know where this is going.. so we are out tonight, i am a good bit faster then they are, ... we pull in a gas station, fill up, and leave. he pulls out in front of me (both of us have 2 passengers)... and takes off (loud exhaust) down the 4lane road (45mph) .. I leave from a farther back entrance, and hearing his exhaust i step on it (no tire spin, etc).. he is maybe 4 cars ahead of me, and by 60ish (i hadnt maxed out 2nd all the way) i am up right behind him in the other lane... he slams on his breaks, as do i (he has valentine one.., so i follow his lead).. blue lights go on behind us.

the cop is behind my buddy (whom i passed) and he pulls over into a parking lot, I kept going thinking i was off the hook... and get int he left turn lane (where we were going to begin with) at the next redlight (right there) and wait at the redlight. the cop sits in the middle lane of the 4 lane road and waits (i guess thinking iwas running, although why wouldnt i have kept going or ran the light...).. the cop spins his tires and comes up and cuts me off (i am at a red turn light , not moving) "GET YOUR *** BACK IN THE LOT WITH THAT OTHER RACER OR IM TAKING YOU TO JAIL THIS SECOND!!!"

i uturn at the redlight and go back, and sit there. I take off my seatbelt and get out my wallet to get my license for him as he is walking up cussing me out , many f words... he yanks my license and insurance from me (never asks for the registration) and keeps cussing, he says he is taking us all to jail.. 4 cops show up , lights on... he spits at my car, hits the back window/door with his hand (hard) and walks away cussing more at me... after 30minutes of dealing withthem all, i get 3 tickets... drag racing, wreckless driving, and no seatbelt.

I was ****ed, because he put a few things that are gay but might work to my advantage, I need legal advice and i think i might have a chance of getting out of it.

First of all, he put that it was '98 nissan, not '95 nissan maxima...

secondly, he put "drag racing at high rate of speed" but he never clocked me or recorded a speed...

thirdly, he put "subject racing in traffic" , and then recorded the time "23:50" , , how much traffic can there be at 11:50pm haha, NONE. its not cali here, sorry...

fourthly, i had my seatbelt ON when I got pulled over, and all 6 of us went to the police headquarters and told the chief that , and reported the officers TERRIBLE behavior ... and the chief was calling him in immediately to discuss the behavior.

the chief said just plea innocent, explain the situation that we werent lined up, that we went 60 in a 45 and accelerated quickly, and about the seatbelt when taking it off for the wallet before he got there, and how he treated you and overreacted , etc...

is that what i should do, or should i get lawyer and fight every minor thing(98 nissan, not 95 nissan maxima)... and see whathappens?

any advice? thanks in advance.

 

get a good traffic lawyer.

do you really want to take the chance and get convicted? cuz if you do, you might as well bend over for the insurance co.

 

That REALLY sucks dude...that cop was WAY out of line though...

Another member on here got a drag racing ticket last week because the accelerated quickly out of a light (no spinning of tires or chirping second) and a FOUR BANGER contour also accelerated quickly...so the cop pulled them both over.

Do what the chief said and make sure you get a good traffic lawyer.

 

That's really weird that the police chief would say the officer overreacted? That's not the type of partner I'd want if I were in that line of work, they're supposed to have a code, a blue wall of silence if you will. Even working in IT I can't stand colleagues who like to blame others to STOA, we call 'em Cave-in Charlies.

Anyway, see what the penalties are. If you're all civil stuff a lawyer can't do jack if you ask me. It's only if you're facing criminal stuff you need a lawyer. In other words, if you got DWAI in NY not DWI, you don't need a lawyer. If you got the latter, yes you do. I'd think those charges could result in a suspension and maybe on your record 10 years? So if you're more comfortable just get the lawyer though they are like a Eureka vacuum cleaner when it comes to your checkbook.....

 

This is a good example of a bad cop, and a good example of how to post regarding your experiences, unlike the member a few days ago who thought calling the cop names and not taking responsibility for his own actions behaved here a few days ago.


I would definitely fight it, ESPECIALLY for the verbal abuse and striking of your car. That's just stupid. Since you have a witness in the car with you, they will be able to back you up.

 

Get a good lawyer, go to court, win, and smile at the piggie when you leave.

for these occasions you wish you had a little mini recorder to tape the whole thing and the cop would have no idea. tough break but i think you will get cleared for everything but maybe speeding but you said he recorded no speed so i don't know. just my $.02

 

That sounds like what your should do. After all, the chief told you! Most of all, even through the cop sounds like he was just trying to show his muscle, (jerk) be polite to them when you see them in court!

Sounds like you have everything in your favor. The ticket is even written out wrong ie 98/95 no prof of speed and even the time. It's all in your favor, use that info. correctly.

 

so most everyone says get a lawyer... hmmmm, my last ticket (almost 2 years ago... at 140mph) cost me alllmost the price of a supercharger in lawyer fees, but it got taken off.. I cant pay that again ! any suggestions on how to find a good traffic lawyer? also, i am ALWAYS extremely polite/humbled when I get pulled over as it has gotten me off the hook COUNTLESS times... this guy could care less how I acted he probably wished I would have been sarcastic so he could justify strangling me or something haha.. .the cop who pulled over my friend the night before, was recording everything - GEEZ i wish this cop last night was doing that !!!!!

my hopes are to get it all taken off except speeding or wreckless driving, because i will plea my exact case, going no more then 60mph in a 45 , so that would not be a big ticket, or wreckless for accelerating quickly (4 of 12max points)..

there is no $ on my tickets except seatbelt is 76$ , the other two are mandatory court and racing is possible 90day suspension, wreckless is 4points + $ decided in court

DO NOT PAY FOR A LAWYER... what state are you in?

if the cops puts ANY wrong info on the ticket it WILL get dismissed... just walk in the courtroom.. tell them you dont have a 98 maxima... and it is dismissed.. GUARENTEED... i live in texas.. they give tickets out like there is no tomorrow... there are certain things that will get a ticket dismissed without arguement and this is one of them.

 

Be honest and confident when you talk to the judge. Bring up every point that you brought up here. Don't be assertive but rather act humble. Don't appear angry at the officer. A lawyer can be good or bad. Judges usually get very angry if you bring a lawyer into traffic court. Also remember that the officer can't clock 2 cars and if he stated that it was in traffic, how the hell does he know what car he was clocking. Radar isn't specific enough to pick out 1 particular car, that's why laser's are being added. Get hit with laser and you might as well get your check book out. You also need to tell the judge what the Chief said to you. Worst case scenario is you get charged with everything, but the cop and the chief will be in hot water. Always cary a small recorder with you from now on.

 

Although many here have experience with the law, I would definitely get a lwayer. Laws vary from state to state and city to city.

I just got pulled over for tint and clear corner lights. Tint is legal i NY, I am in PA.

Find a friend with a good lawyer and use him when needed. It will not cost you very much and is well worth it.

Good luck and sorry to hear about this. I think a lot of these cops see modded cars and target them specifically.

hm, well i dont know about kentucky, but in MOST places, judges and law enforcement crack down really hard on street racing. if they even suspect anything of the sort, it could mean less leniency, meaning you get a HARSHER sentence! even though you werent ACTUALLY lined up, im sure theyre going to consider that you were racing.

first things first, unless you WANT to pay all the fines and accept all the points on your license, plead not guilty. in some states and counties this may even require you paying some money. in berrien county here in michigan where i live, i had to pay $100 in order to make a plea of not guilty. pretty lame eh? of course, it IS refundable, but only if you win your case.

i really would advise you to get an attorney. these matters seem trivial but in actuality, we're talking about your very livliehood here. what would you do in this country if you were no longer able to drive? what if your license was suspended for a year? or EVEN six months? if that is something you can deal with... if youre confident in your knowledge of traffic law and think the advice from an online forum is all you need to arm yourself against this charge, try to fight it on your own (good luck).

You cant record someone and use it in a court of law unless you ask them if its ok if you can record them to begin with. So unless you guys plan on asking the irate cop that very question, 86 that idea.

Listen to what everyone is saying about traffic lawyers. In Seattle, my friend and I used the same guy for 3 tickets and he got us off EVERY ticket.

DO NOT try and fight this on your own. I have been issued a total of 11 tickets in my driving career and only got off 1 by representing myself (dismissed).

Unless you are "Will Hunting", get a lawyer and best of luck!

(By the way, I paid $230 to the traffic attorney for each ticket, dropped or not)

 

From personal experience GET A LAWYER!. Get a good lawyer from a very well known firm!! It will cost a bit more up front but WELL worth it. Here is my experience.

A friend and I in our Sciroccos heading down a local freeway racing. No doubts about it. My friend was paced at 110 in a 50, and I was WAY ahead of him. We went through an interchange about 5 miles later, still at a considerable speed, hitting the apex's etc (I know this becasue it was in teh police report that the cop could barely keep up!) Went another 2 miles up that interstate, before exiting. When we stopped at the light (Mill Plain & I-205 for you Vancouverites) about 30 seconds later 6 cop cars blocked us and the intersection in! We were yelled at, cussed at, out cars towed, an we were taken to jail. On the way to teh jail the car I was in had two cops, asking me all sorts of questions (they weren't the ones pacing us). I kept my mouth SHUT the whole time. When we got to the station, the booking officer asked the arresting officer why in the hell we were even brought in! But since we were there they booked us and his wife had to come pick us up. I got a great lawyer from Webber & Gunn (Ernie the Attorney), he spent about 15 minutes with me, then went to court for me, and got me off with court costs, and a $100 fine. Nothing on my record. My buddy got a cheap a** traffic attorney, and ended up with about $300 in lawyer bills, and still got the ticket on his driving record, costing him eventualy hundreds in insurance costs.


Get a good lawyer! F**K the cops, usually they don't go by the book, and play the good ole boys, especially state patrol guys who think they are above it all ( even my next door neighbor).

Since then I have report EVERY single time a cop barely runs a red light, flips their lights on to blow a stop sign, etc. One time a stater had the ***** to nearly run me over when I was IN the crosswalk in front of the courthouse (filing divorce papers, not for a traffic citation). I had a couple of witnesses, we all marched back into the courthouse, filed formal complaints, and I demanded it go on his permanent record. It did.

The cops in this area have pi**ed me off too many times! Especially EVERY time I see them do something illegal. I have followed cops till they stop, and gotten their badge number just for not signalling.

Sorry about the rant and rave, but cops and I will never get along.

 

i understand his side and i feel bad, but he was wrong...u think a judge is gonan believe some the truth..well sir i was speeding and racing but the cop was mean to me...can u dismiss cause he wrote the wrong year of the car...come on people.

 

if the judge has to believe your word or HIS WORD, who do you think he will believe?? obviously the cops!!

that is why you should get a lawyer, so he can get you off using technicalities, not your "story"

ok, after speaking with 5 attorneys, I decided on the most expensive / well known firm, and their charge is 375$ for the first appearance, which should be the only one and the lawyer said it should not be a problem.. probably get the drag racing taken off, pay 25$ for seatbelt (EVEN THOUGH IT WAS ON!!!!!!!!!!!!!!!!!!!) and then go to traffic school and pay for reckless driving.. so no points, just a fine... said it should not be a problem to have that done. if it is, then i have a hearing and the cop is subpoened to come in, and costs me big $ and I get all 5 of the other guys to testify for me, etc... yuck

 

That is VERY untrue....someone told me to do that one time....I tried it...and the judge LAUGHED AT ME. They don't car if it was a 95 or a 98....both cars are pretty much IDENTICAL.

 

What about if they make a mistake on the license plate? My friend just got pulled over and his license plate was written down wrong; so does that mean the ticket is dismissed or is that B.S. Too?

if the chief gave you advice and it sounds like good advice you might be all set, sounds like he's a kewl guy. get a report from him about the officers behavior to bring with you to court.

 

I call the station, and file a formal complaint, if it is really bad i insist that it is put in his/her file, and a copy sent to me.
