Plzz!!!!Help with ticket4speeding over100

Hi.....Im a newbie here.....I really need u guys help...
Last Sunday, I was driving my max from LA back to San Jose, at around midnite. I was driving on I-5 around 2AM, and I was around 30 miles to change to hwy152. I was driving over 100 all the way, until I was trying to pass this truck, and suddenly, I saw a redlight flashing on my rear mirror, the next thing I knew,"$h*t, Im busted." I was pulled over to the side, then the cop came to me and the first thing he asked me is,"how fast were u driving 10 miles away." Then I thought,Damn, i was being follow for that long and i didn't realized. Then I said," I don't know." Then the cop asked me for driving license and registration, and I was like,"wut's car registration?" cuz I seriously had no clue what's that. Anyway, the cop told me that I could be arrested for driving that fast, and he asked me to sign the ticket with 2 violations, one is speeding over 100,and the second one is a fix ticket for showing registration. They radared my speed was around 107 on 70 zone, but they put down 90 for the maximum speed people can drive there. Any suggestion on what I can do or What should I do????Should I plead guilty or not guilty???
I already have 2 pts on my record, and the first one is accident,and the second one is speeding 80 on 60 zone. This is my third one. Thx for taking time reading this, I know it's pretty messy but.....I feel helpless now.

Not sure you would be able to fight that, you could try to talk to to the judge and go to a driving school or something

But I thought you can't go to another traffic school if you already had it for past 18 month, and I already had it once...

ok, didn't see that. I don't know then. Were the tickets with the same police department, ie same city? Sometimes you are put on probation in a city, it doesn't transfer over to other cities.

It was in different city, I was caught this time at los banos or something like that. Another question, since the court is 2~3 hrs from where I live, is it possible to transfer case to the court near my address?

if you speed over 100mph in California it is a two point ticket same as racing and DUI. in other words it is a felony not a mistermeaner. I recommend thinking about talking to a lawyer.

Man...I committed a crime????sounds like Im a criminal now.....><...this is bad......never realize driving over 100 is a crime...

I don't know about Cali but in New York all of those things that you could do with a car would wind up being a misdemeanor at worst, but if you had no previous offenses you'd plead to a violation. Also, the worst case scenario you'd have your license suspended. I think the other poster is getting carried away by telling you that you committed a felony. If I were him I wouldn't quit my day job at the DQ, maybe see if I could get a 2nd shift at bk.

Anyway, if you have any doubts let your fingers do the walking and call an attorney. Nobody likes to deal with them but it is one place in the world that you can get free advice, reason being there are too many of them so they have to compete. Believe me, whatever happens it's not the end of the world. If it were really serious you wouldn't have driven away, you would have been taken away and your car impounded. Good luck.

Go to court and plead no contest, and ask the judge if u can take a driving class. When you plead no contest, you dont admit your fault.

I dunno about Cali, but in Florida you can have the case moved to any county courthouse in the state as long as the State Highway Patrol gave you the ticket. Depending on who did (I just skimmed) you mihgt be able to do that and have the cop not show up in court. If that happens you get off with just court costs. You may be able to do this with local police departments also.. I 'm gonna go with the majority and say at least ask a lawyer about it.

You deserve to have your liscence suspended for going that fast. Even if it was 2 a.m. I wouldn't be going that fast. Maybe 85 - 90 at most. Over 90 is usually considered really wreckless.

Just be thankful he gave you a ticket for 90. . . If he did give you one for speeding and doing 100, it would be reckless endangerment and it would be on your record for 5 years instead of 18 months. . . That happened to me when I was 17, caught doing 59 in a 25. . . While you do have to deal with the points, I don't think it would be worth your while to try and fight it. . . The judge will just laugh at you. . . And I doubt that they will change jurisdiction, they wouldn't when I got a ticket in one county and I had to drive just over 2 hours to challenge it.

In Toronto that would have been a court notice instead of a ticket. The judge would have set the fine for you that you would be paying off for the rest of your life.
Talk to a lawyer about it, that's your best bet I think.
And I doubt that they will transfer the court to a different city.
Just hope the cop doesn't show up!

here's what I remember a LAWYER on thsi board saying...

that he does for his clients with speeding tickets. (call your lawyer NOW of course because this could be serious and you wanna try to get the least you can out of it) Now, ask your lawyer to ask for a jury trial, and to bargain to get it put as a non-moving violation. Non-moving vipolations means that you pay whatever the amoutn of money on the ticket was, but you don't have to worry about classes, suspensions, points (insurance) ect. Paying full ticket amount isn't bad since your raised insurance would be much more then a $200 ticket. Good luck.

I am not sticking up for driving that fast, but I do understand the speed on this particular stretch of road. . . For those that don't live in CA, once you are in the middle of CA on 5, it is an open stretch of freeway where you have open flat roads. People routienely go 100 on them, and rarely get pulled over as the CHP are only in certain spots, as it is pretty much in the middle of nowhere. It is always a risk to go that speed, but on my trip home I normally go 85 and I am getting passed right and left in the northern part of CA. Since everyone else goes an excessive speed, if you aren't paying attention, it is also probable that he didn't know he was that far over the limit, hence the reduced speed by the officer.

How about some sort of lesser of two evils...

If you did the speed limit you would be a danger on the road, possibly causing accidents and or deaths!

You may be able to plea guilty at just under the felony speed for a quick resolution. This way you won't be picking up any soap.

There are a bunch of tricks.

First, I believe that you have to go the district in which you recieved the ticket. The cop has to appear in court to give his statement about what happened. Without the cop, you don't get fined, but just have to pay court costs. This is the premis for most of the tricks.

1. Keep pushing back the court date. You can make it last like 2 years or something I think (at least in NY you can). After 2 years the ticket is dropped.
2. Or change the date so much that the cop just forgets about you and the incident and doesn't bother to show up.
3. Schedule the court date for the cops day off. (keep calling his main office and ask for the officer, whatever day he can't answer the phone because he's not in....that's his day off) No cop want's to be bothered with a two year old ticket on his day off.
4. Try to have it moved to a different district, (he'll want to come out even less).
5. Make sure that he actually has proof that you were going that fast. Many times, cops don't use the radar, or record the results. They just seem to be your buddy when they tell you that they lowered the speed on the ticket, but they really don't have solid proof of your speed.
6. If radar was used, check the calibration date and make sure it falls within spec.
7. If he didn't use a gun, and spouts BS like "I'm trained to calculate how fast objects move"... pull a coin out of your pocket and ask him to tell you have fast it hits the floor.
8. Find out if it was the end or beginning of his shift and how long he was sitting on the side of the road. Chances are he was pretty tired, and not very aware, thus making it seem as though you were traveling faster than he thought.
9. From what I can recall, COPS ARE NOT ABOVE THE LAW!!! Nobody is allowed to break the spead limit, not even cops. Chances might be that the cop was just cruising along, faster than you were, and caught up to you. Instead of passing you and heading on his way, he decided to pull you over and bust your *****. If he was speading in the first place, without an emergency, he just lost his paddle.

There are tons of ways to do it. Just try a little research.

Never mind, i am stupid. Speeding is not a felony it's just an infraction. Here is the link is the california law looks like a $500 fine and you may not be able to drive for a while.

Thanx everybody....I think i'll go with the trick, I asked my friend's cousin, who is in lawschool, he told me to do that trick. He also said, if the cop, however, does show up, just plead no contest because he doesn't think there's a even little chance that i'll win over the cop. BTW, I was so mad on that day, after i got home, i immediately order a radar detector(bel 980)...Hope that'll make me feel better while driving
