Got into accident..how to deal with insurance

ok here is the story. I have a 4th gen max. I was coming home thursday night and i get rear ended. I have the R34 body kit on my car. The rear bumper is absolutly trashed . how would i go about haveing the insurance company replace the body kit bumper and not the stock bumper

Any time you're a claimant in an accident (Like in this case....since you got rear-ended), the insurance company needs to replace the bumper with the same type of bumper that was on the car at the time of the accident. Their job is to "restore the vehicle to pre-loss condition." Be sure when getting the estimate done, to point this out to the appraiser. Maybe, you may want to provide a web address or phone number of the dealer or shop you bought it from to help reduce the time the appraiser is going to take to locate the bumper and get a price. It shouldn't be a problem. IF, anything strange comes up, and they say they won't replace it with the same one (I've never seen this happen), file the claim through your own company.....providing they cover for aftermarket accessories. but say i want the stock bumper on could i just say i am puttin the aftermarket bumper on and pocket the rest of the money??

Depends on the insurance company. Some insurance companies will allow you to "cash out" on certain portions of the repair ( i.e. the rear bumper cover.) but not all. Check with the adjuster who is handling your claim.
