Very Frustrating 2 weeks!

so 2 weeks ago some 65 yr old pot head backed into my car.... she still has not contacted her insurance company which means they wont do anything to my car unless i go with my insurance, well the door lock is now broke as many of you know if it wont lock then the rest of the doors wont stay locked either! so i go out to my car today.... what do i find my stereo is gone... ok so im ticked but thats not all they jammed a screwdriver or something into the ignition and now i cant even put my key in to drive anywhere! i am a little upset about this had the door lock not been broke then the alarm would have went off... ugggg.... sorry guys i had to vent for a minute thanks!!

Don't wait around for that moron to turn in a claim, call the insurance company yourdelf. You can file a claim with HIS company without him knowing. They will call that POPHEAD to verify the fact of the loss.. The ins. co cannot pay out until they have spoken with their INSURED.. But you can get the ball rolling.

Do not pass go, do not collect $200, go DIRECTLY to the police and tell them the person who hit you is not paying.

did you not have the cops show and file an accident report when it happend?!

If not, then you're pretty much skrood, because you have no physical proof that she hit you. her insurance can deny the claim and you're f***ed.

no i did not have the police there, i should have and i now know that her insurance company claims they have tried to contact her every day, got her son on the phone one day and he said his fater had a stroke and she was at the hospital a lot, now her voicemail is apparently full... i guess taking 5 minutes of her day to call her insurance company is a little to much...hmmm thats okay when she does not file an accident report in 30 days they can revoke her drivers license...hmmmm

I would call her @$$ 24/7, espically this weekend. She is bound to be home over the holiday. Keep harrassing her, and tell her to get her butt in gear.. Get that claim filed...

Remember the longer it takes, the more it hurts right?

Move out of Portland, like I did before it's too late for you. That place sucks now. Move somewhere nice where there aren't as many idiots breaking a $200 door lock to steal $10 worth of CDs. Move past the sprawl to somewhere like Corbett, Scappoose, Washougal. I moved all the way to The Dalles to get away from that crap.

You have her insurance company and policy number, right? Just go through her insurance and forget about the lady herself. If they play dumb, go right to YOUR insurance company. Your company will work for you on this, otherwise, THEY will be paying. I've had this happen to me before. I just hounded my insurance lady and she took care of it.

You should get an estimate from a body shop, too. In Oregon, if the damage is over $400 you are supposed to file an accident report within 72 hours (you are really behind -- call your insurance Friday for sure)

The only problem with going through your own company is paying your deductible. Your ins. company will SUBROGATE with her company (get back what they paid out) and your deductible will be reinbursed, plus any loss of use (rental car costs)...

The only problem is, it could take 6-12 months after the claim is finalized to get your deductible back. My ins. company has been fighting with Progressive for a year and half now, over some B*TCH who slammed her door into my car.

Your other option is to file a claim against her in small claims court. This will get her attention REAL fast.

Unless they fork over cash at the scene, never take their word for it.
