Sounds to me like you left the flow of traffic and then re-entered it. Did you put your left turn signal on? If you did, you may be better off in court. If you did not, she probably assumed (not far off) that you were parking..

I think she was probably speeding up to pass you in that case. Whether or not you can prove her speed by the damage, I'm not sure.

Of course she was probably cruisin along paying no attention and was too slow to react when you flipped a *****

Glad you're ok, sorry for your loss. Like others have said, check the laws for your insurance coverage, and talk to the cop who took wrote the report to see if you can wiggle out of some of the responsibility. It might be 80/20 or 75/25, and it's money you could use.

Because he u-turned in front of her, that's how. Also, how was it clear? He was hit by another vehicle.

Anyway, it's good you didn't get badly hurt. My dad totalled his 95 maxima a couple of years after buying it. Rolled it a few times on the highway. I've been in like seven accidents before (none major, and I was only driving once - I think I am unlucky on people!). It's a bit surreal, but then when it's over and nobody was hurt you realize that it was just some dumb metal that took the brunt of it, and things are better then

You didn't explain the details of the accident much, so definitely see what the cop has to say about it. If it wasn't entirely written up as your fault you need to minimize the payout you have to do from your own pocket, though based on your first post it sounds like it was your fault, which you're aware of.
