With the LSD sometimes I would get 2 patches sometimes not, it also goes away once it heats up a bit so its not really useful at the track.

I feel drunk after reading this thread.
The VLSD tranny can be identified (as others have said) by the transaxle code indicated on the firewall panel.
Jacking up your car and spinning one wheel will result in the opposite wheel rotating in the opposite direction w/an open differential. I have never had access to a VLSD to confirm how it differs.
If you have the transmission off of the vehicle, you can tell by the size of the axle holes. A VLSD transmission's driver's side hole will be substantially larger than the passenger's side; an open differential transmission's axle holes are approximately the same size.
Here's a chart straight out of the FSM:
