Dealer wont recall EVAP because of y-pipe

I recently pulled a 0111 code.
It's the EVAP purge code.

I took it into a nissan dealer and it turns out that there is a recall on that item specifically for a car my mileage in my year.

However, because I have an aftermarket y-pipe on, the tech said he cannot perform the recall. He said he can do it if I have the original parts but I don't have my ypipe anymore.

Plus, it's really hard to find a fed spec y pipe in California junk yards.

I keep thinking that the guy should still replace the evap purge canister since it is not directly related to the y pipe.

What do you guys think I should do?

Are recalls only performed at dealers?

It's the law (Fedral) that the dealership must fix any recall on your vehicle. As long as your year and model is listed on the recall bulletin you're entitled. I would call nissan customer service at the corporate level. Let them know what that dealership told you. "I never make deals at stealerships I make threats." To me thats like saying your tachometer was under recall, and you changed your dash lightbulbs to LED. I would fight it all the way.Good Luck

I agree with Trajiks.....auto dealerships are required under federal law to perfom any and all recall bulletins on their manufactured vehicles. Call the regional Nissan representative, and if that doesnt work, go directly to the Better Business Bureau.

I agree with this statement as well, but don't forget that his Y pipe has made his car completely illegal in the state he lives in. That might be reason enough for them to legally reject the repair.

Call them first and ask if they y pipe would cause the evap to fail, don't state what kind you have. If they say no, they will have to fix it, Try this at another dealer close to you, not the same one. That is bogus but its a cheap part anyway if they won't fix it.

what does it matter if you have an aftermarket part on there or not? they cannot refuse to fix the recall unless they prove that your ypipe is the direct cause of the 0111 code. aftermarket parts do not void warrantys unless its the cause of the problem. its a law and its posted somewhere on the org.

In my eyes a recall is a recall. This is something the Manufacturer takes full fault for. They admit that their is a flaw with the design of their vehicle. It is required to fix the problem, if they didn't want to fix it they wouldn't post a Nation Wide recall. Doesn't matter if the Y-pipe caused this or not what they said it;s not right. I wish Nissan would do the same for Coil Packs, but I won't even go there.
