No it shouldn't matter. When the engine is off, the oil is in the pan or stuck in valleys and not under pressure, so unless your pan has a hole in it, the level isn't going to matter.
Engine running, the oil is moving and under pressure, regardless of the mix/max level. If you've got leaking seals, this is when they are leaking.
