Really pissed now...
So I go to pick up the rental car while they finish my bumper. What do they have the gall to give me.... A CHEVY METRO. They also don't want to replace the TCM when they replace the Tranny. I've had the car in the dealers 4 or 5 times complaining about the behavior, all the sudden the Transmission is shot!? I don think so. What do you guys think, my car was made 11/99 should I push the TCM at the same time?

I would've put up a fight but I had to get back to work and I'll only have it for one horrible night.

Check if there are any lemon laws in your state. If that car sees the shop for the same problem several times, they may be required by law to replace the whole car. ***Don't quote me on anything I said, I'm not familiar with this topic, just offering a sugestion***
Lemon Laws are dependent on the state you are in. Here in MD, if you take the car in to the dealer three times for the same problem without it being resolved, you can force the dealer to buy back your car and get you a replacement. My dad did it once before that way.
Wow... replace the tranny?? What happened? Mine slips under WOT when cold. Other than that its pretty good.

They don't want to replace the TCM???
Man, you are showing tremendous restraint..I applaud you for it...I would be hitting the roof..I mean absolutely imploding...we aren't talking about rattles here...man...tranny already?
If it makes you feel any better I got a Dodge Neon for a couple of days when they were trying to fix my engine mount chirps. Made me appreciate the Max a lot more when I got it back..not enough though
As bad as the Neon was, not one stinking rattle in it ...of course it sounded like it was gonna blow up but no rattles

no way...
You tell them you refuse to drive that car a single mile with the updated TCM. The tranny WILL FAIL AGAIN with the old TCM. The TSB clearly outlines this. Except, it might not be under warranty next time.
Also, if the lugnuts read the TSB, it says Check TCM, replace, then if still slipping, replace tranny. They arent following the directions. Call Nissan NA. I wouldnt leave the lot without the new TCM. period.
The TCM is a 15 min fix. And Nissan will pay for it, so just flat out ask them why they refuse to follow the directions on the TSB. What are they worried about. maybe they like replacing trannies.
If all else fails, try a Jedi Mind Trick® on the service manager.

I second what Tim said. If you don't fix it now, what happens if your tranny goes out on you right after the warranty expires? That's going to be money out of your pocket.

well....
I just talked to the service manager on the phone and he's sticking to the transmission replacement. He did say that the sollenoid is replaced in the tranny.. apparently they have been known to be defective. Has anyone heard of this. I asked him for a full printed copy of the TSB and he's gonna give me that. Hopefully I can get him to see my side. Who knows.
Oh btw, he says Nissan provides no rental car for warranty work and that was the dealer's decision. He did say if I needed another they'd try and get me into something more reasonable.
Not batting 1.000 but I'm not done yet.
