side mirror problem

my driver side view mirror is loose (the whole thing is loose where it attaches to the door - it hangs a little bit even) and i took it into the dealer to have them fix it under warranty. the service guy took a look at it, pointed out a little smudge and said there is evidence of impact and it might need a few new clips or it might need a whole new mirror. he said 'we'll start at about $75 and take it from there". i said if it's between the bumpers, the warranty should cover it. he said not if nissan gets the part back and thinks that it was caused by an impact. the smudge wiped off, but left a tiny hint of blemish on the paint. i understand if the thing got bashed real good and they wouldn't cover it, but if the little smudge is responsible for the malfunction, then why didn't the mirror fold on its hinge? it obviously didn't get hit that hard (if it even got hit at all). has anyone else had a similar problem? is this a weak spot on the maxima? Any warranty claim advice?

just try another dealership...the warranty claims varys...
