hesitation problem update

Here’s an update since I know some other people have had this issue:
Problem is a "hesitation"- more like a surging forward and back- while holding the throttle steady 3K-4K RPMs. Only when it’s hot outside.
I’ve been to the dealer repeatedly now, and nothing has been accomplished.
What has been done so far:
1. Reprogrammed ECU
2. Replace Throttle Position Sensor
3. Reprogrammed ECU again
4. They have a brand new ECU in the mail, they’re going to replace the entire unit.
I did do an interesting test with the mechanic- he hooked up a computer under my steering wheel and took readouts while hesitating on the highway. Here’s what came out of it:
With RPM’s generally steady, computer read "throttle closed" intermittently and adjusted the timing accordingly. So, at about 73 MPH and 4K RPM in third, my ECU was retarding the timing from something like 68 degrees all the way back to one. Because it thought I was off the throttle.
(Did this test BEFORE replacing the throttle position sensor.)
I’m just reporting this info back so hopefully others can avoid the dozen or so trips I’ve made to the dealer now.
I’m thinking about going lemon law if this next fix (#4) doesn’t do it…. Anyone know how difficult this will be?
