I am betting you and your son are feeling pretty sore at this point. Yeah, seat belts save lives but chest soreness is common from the restraint...good trade-off! Glad you are both following up with medical professionals. Usually, your own auto insurance company provides some coverage for medical bills under Personal Injury Protection but typically only enough for an exam and a follow up. For any medical expenses over one's own insurance, people may seek recovery from that at-fault driver's insurance for that as well as pain&suffering and long lasting/permanacy of those injuries. The "aggrevating" factor that the wrong-doer was DUI typically induces the insurance company to pay at the very high end of what an injury claim is worth. The wrong-doer's insurance company has a duty to protect the pile of crap financially and they know that juries tend to award at the very very high end of injury value if the matter goes to court. The wrong-doer typcically is non-cooperative because of the pending DUI charges. In your case, the witness and the fact that he was arrested for DUI should easily carry the day for you. I hope you do get another Maxima because I have valued your advice/comments in post on all subjects.

Yeah, I've had my detailing business full time since 1994. Been at it a really long time now!

Optimum Finish is a great finishing polish with light cut. Really wet finish and compatible with sealants or waxes.

Gary-right now it is such a pain trying to get anything done since the drunk won't talk and the police report isn't ready. For right now, I am borrowing my Dad's '04 V6 Accord until I get a rental. Trying to avoid paying out of pocket for one since it could be a few weeks before the other guy's insurance accepts financial responsibility. I like the Accord, but my Maxima is definitely quicker, the difference in mid-range power is very noticeable!

My first choice is another Maxima, already looked at a couple of '03s. Neither one has the cold start rattle, so that is a good sign.

Glad you guys are ok. You should def sue, you will get some insane compensation since it was his fault and he was drunk. My mom and sister got hit by a drunk many years ago but they were fine. My sister was in a 95 Civic and the drunk had a Dodge Ram. Sister got T boned, i was supposed to be in the car that night riding in the backseat but didnt go, thank god I wasnt ther bc I would'nt be here right now if I joined them. My sister went to make a left turn into a parking lot when the drunk was coming the opposite way and he hit her. Technically it was my sister's fault bc of the right of way rule.

damn, sorry to hear about your car, its good to see you and your son walked away from that. good luck with the insurance, i been fighting the insurance over a month over a minor fender bender, its finally going to get repaired tomorrow. I have state farm, there great, its the guy who hit me insurance thats dragging there feet.

can u describe that cold start rattle? is this a common problem?
I remember hearin my ride start at the dealer have a weird ticking, but it never did it again that i know of.

Arlington Police finally finished the accident report, which states the other driver ran the light and was arrested for "driving while intoxicated-felony repetition" and his BAC was .216.

Now his insurance company better start throwing some money my way...

Took me well over a month to get my money from a simple failure to yield. The other guys insurance company moved at glacial speed.

He did try to run. He got back in his truck and put the truck in gear and I yanked his door open and threatened to come into his truck and pull him out face first into the pavement. That's when his idiot friend who was following him home instead of driving him home came over and took the keys out of the truck and got his friend out.

Based on the police report, this is not his first DWI.

Biggest thing I can say is to be proactive about it...search Autotrader listings for your area (within 50 miles is probably a good representation) for 5 and 5.5 gens to have ammo for what the going rate is for them in your market area.

Also, see if you can get them to pick up a rental car because now you are without transportation. This will mean that they are spending money every day that goes by that they don't settle with you. This will hopefully speed up the process of getting to a price that both you and they are happy with. They may try to **** you around and say that they wont do it, but looking at the newness of that guy's truck, I find it hard to believe that he didn't have full coverage as would be required had he leased/financed the truck. They may say they'll only cover a portion...fine. if it's $30 a day, get something cheap that's $20 a day. And don't fall for paying for insurance if your own insurance company has you covered already.

Haven't been on the org in a while and just saw this thread Scott. Sorry as Hell to see your car end up like this but I'm happy to see you and your son make it out ok. This could have been MUCH worse! My friend is an accident investigator and you can't believe the horror stories he tells me. He says that side airbags are the most important things you can have on a car. It doesn't look like your Max had them, but on your next one make sure to get them.

Oh and I know you're an excellent detailer but I'm afraid even you won't be able to buff this out.

Finally got a rental, really pissed at how Farmers is handling this so far.

Called them yesterday to let them know the police report was available, no call back today. I call them around 12:30 PM and they said they didn't have a copy and I should fax it over. I did about 10 minutes later. An hour goes by, I call and the claims adjuster said she would have to check and would call me back. Around 3 PM I called, she claimed she hadn't received a fax and when I said I'd bring it down personally, she then said my lawyer had just faxed it to them. I told her the police report made it obvious their driver was at fault and I needed a rental by the end of the day. She said it wasn't possible and said she was transferring my claim and hung up on me. I then called my insurance to let them know how uncooperative Farmer's was being and asking them how I should handle it, plus I called that claims adjuster's supervisor and said I was tired of getting the run-around every time I called. 30 minutes later I get a call from the supervisor saying arrangements were being made with Enterprise and I'd be able to pick up a car this afternoon.

BTW, I got home, checked my e-mail and my lawyer had sent over the accident report at 10:30 AM.

You would think an insurance company would want to take care of claims like this promptly and maybe make a new customer rather than just **** people off.

Probably be tomorrow or Thursday before they look at my car, at least next week before they make an offer on it.

They gave me an HHR. I sure miss my VQ35 now.

Things to know about Farmers -

Their claims center is located in Oklahoma City
When you send them a fax, it goes to Washington state where it is converted into an e-mail
Vehicle values are based on Oklahoma City.

If you find a car that is similiar to yours, print out the ad and save it for when they low ball you. Save the ads even if you aren't interested in the particular car and it doesn't have to be the same year as yours.

Zero chance I'm getting something with a CVT. Actually less than a zero chance.

Probably another 5.5 gen. I really don't want to have to make payments again and for what I will likely get for my car, I can get into another 5.5 gen with less miles than mine had on it and nothing out of pocket. We've had some pretty bad weather on and off the last 3 weeks so I haven't been working that much-winter is not the time for me to go into debt. If this happened in the summer it would have been a lot easier.

Dennis-the lawyer is only involved on the injury side of the claim. No chance I'm letting a lawyer get 1/3rd the value of my car.

If Farmers tries to lowball me on the value of my car, I'll take Nationwide's offer and Farmers will have to pay them back that amount and pay me my deductible.

wow sounds like their insurance company is being a PITA.. when i got in a wreck, i was issued a car rental that same day (i demanded it since i had no transportation). got in a wreck at 8am and was in a rental before enterprise closed.. also, you should be able to get into a better/bigger car than the HHR.. i just asked my brother (he works at enterprise) and an HHR is considered a standard car, our maxima's are full size. and the maxima's enterprise rents out is premium.. you should be able to atleast get a full size car, i'm not sure if enterprise in dallas carries the same cars as okc but over here, a full size is a impala, charger, camry, and some other cars much better than the HHR.. so demand to move up from the POS they gave you..

i'll keep a lookout on craigslist for 5.5gen maximas.. i was on earlier and found an 03 pearl white auto SE with 114k (mostly highway) fully loaded with heated seats/steering wheel for $6300 OBO.. i was tempted to email him but didn't at the time, now i searched again and it's been flagged.. but i'll keep a look out and let you know if anything pops up

heres a 02 for 5k but doesn't list milage, might wanna give him a call if you're interested

Why not everyone just post up CL ads in his area of your 5.5 gens for like $12k-$20k?

Then present the ads to the insurance company and if they don't believe you just tell them to look up CL right there on the spot...

tookrzy4u192-Enterprise actually came and got the HHR and brought me a Malibu. Something about the HHR needing servicing. I was going to have them replace it anyway since it reeked of cigarette smoke. The Malibu is a lot nicer, very quiet, smooth ride and good handling, decently peppy for a 4 cylinder, although the 6 speed with a manual mode helps. The only thing I don't like is the A-pillars are really wide and get in the way when making left turns. Other than that though, it is a huge step in the right direction for GM. Wonder how the 252 V6 version runs...

Really hope they pay out soon though, considering the tungsten blue 5.5 gen an Austin .org member is selling. Rather just get another 5.5 gen if I can find a good one and pay cash for it.

Had a Malibu for a weekend back in July...AWESOME rides even with the 4cyl. Look nice im and have plenty of room...And the interior they put into the LTZ models (i believe enterprise uses 1LTs) is sexy!!!

Sorry, no VQ35, no care.

Found an original owner dark blue 5.5 gen locally, probably check it out in a day or two after the nasty arctic front comes and goes.

The weather guessers still don't know what to expect here other than single digit wind chills by Tuesday afternoon. It was 75 on Friday and Saturday...

Just pulled the rest of the stuff out of my car and started it for the first time in several days and got the first SES light I'd had in more than a year and a half. P0302, cylinder 2 misfire (never, ever had a misfire code the entire time I had the car) and a P0550, power steering pressure circuit-which, since the passenger side of the car is crunched up against the engine, no surprise there.

Farmer's lousy towing company hasn't called me back about picking up the car and I've never been able to get hold of a live person, just their answering service.

I hope I didn't miss a post about this, but did you get the settlement package from Farmers already? You have to sign your life away and overnight it back to them (they supply the envelop) with the car title and keys. Then they send you a check and pick up the car.
