I think my Tranny is on it way upto the blue sky above

Well, this is what is been happening and getting worse day by day.

First off, every morning when I start the car and put the car in D and HOLD the brake, I hear "grinind/ticking" noise coming from the engine/console side. If I put the gear back in N or P with the brake still held down. The noise goes away. That makes me think tranny problem.

Then biggest problem here, two days now in a row, I floored it at a light to test my new CAI and stuff, and I got a LOUD ticking noise coming right from my gear shift. So I backed off. This happened again last night while in the rain and I floored it and it did it again louder. Again seems to think to me a tranny issue.

Now my problem is that my dealer better not say $hit about my mods (Ypipe, No cat, PRcai, RSB, UDP, PowerTech muffler) in trying to blame them for the tranny problem. But then again I am very very good at creating a scene up in there and very good at arguing if he tried to tell me the UDP caused this, I will tear him a new azzhole.

What yall think? New tranny coming soon? And if so, how long am I gonna be out of a car? I NEEEEEEEED my car. I got the bike, but still too cold to ride.

I'm just wondering, how many miles does your car have right now? BTW, you know that if you bring your car the way it is now, to the dealership, that there is no way in hell that they'll replace anything on. They'll simply blame everything on the modifications you've made and you'll be simply screwed.

Wow, that sucks! If I were you, I would take the car to a mechanic outside of nissan first and get their opinion. Nissan will f**k you out of waranty work with all those mods. I would take out the UDP before taking the car in to Nissan.

I feel your pain--my car is all f***ed up too (i just posted about that). Oh, and the nissan people are b!tches. I don't have a waranty and I'm never taking my car to them agian.

Good luck.

The Magnuson-Moss Warranty Act specifically prohibits auto manufacturers from denying consumers warranty claims because of aftermarket modifications unless the manufacturer can prove that the aftermarket modification was the direct cause of the problem. The burden of proof is on the dealership/manufacturer and not on you.

You can take your car to Nissan and they *will* hassle you and deny you warranty coverage, but they are not allowed to under law. This means a lawsuit and litigation which they will lose, but after how much time, money, and aggravation on your part? And meanwhile if your tranny dies, you're on your own for a car.

This is Nissan's strategy on how to avoid paying out money for warranty replacements when people have aftermarket modifications Unfortunately, there's no law against hassling people

Anyways, your best bet is to either:

A) Go back to 100% stock (I know it'll be a pain, but dealing with Nissan and starting litigation will be even more of a pain)

B) Sell your car fast. Now might be an ideal time to trade up to a 2k2

The last option would be to leave it as-is and pray Nissan doesn't say anything about your mods. But what are the odds of that happening?

Good luck.

Dixit,

Remove EVERYTHING before you take it in! It's the price we pay for having mods and trying to keep some kind of warranty.

I know it's a big pain in the a$$, but it's going to be a long battle and an even bigger pain if you have those mods.

Just my .02.

Nissan does not care about that ACT. They will void your warranty every chance they get. They do not have to prove anything. Its up to the dealer to make that decision and Nissan will back them. My car was stock and got voided! Also 2 other local Max owners got theirs voided too. I suggest take the mods off. Because all they have to say is "The extra modifications increased the HP more than what the tranny could handle".

The burden of proof is on the dealer/manufacturer as per the Magnuson-Moss Warranty Act. Federal law. Nissan just makes it a PITA for you and risks litigation because what they do is in complete violation of this law.

it might not be you whole tranny, mine just went in last week cuz it was making the same type of noise, like a whinnin noise when it was in gear only and would get louder as you stepped on the gas more, turned out to be a Bearing in the differential that went bad as well as 2 in the trans, both were replaced under warr, cuz they went bad

Thats dont sound too bad since you mention it might be the bearings. Your problem seems very much similar to mine. And falls in the right category of a bearing issue, cause once the car is warm, it goes away, which is normal with bearing issues once it gets warmed up.

TO ALL WHO REPLIED TO THIS THREAD:
I just talked to my guy over here at Gaithersburg Nissan who is the Sales manager, he is very very cool. I asked him if they would fix the car without voiding my warranty. His exact words were "Hell no we wont void it." This is the same guy who keeps trying to buy the car from me, which he sold to me only 6months ago. I will only agree to sell to him if he gives me a Even trade on the 2K2 SE fully loaded with Navi. By this I mean get him to make my payments still only $391 a month. He did this for me when I traded my 2K in for a 2K1. Payments stayed the same. I did it for the APR.

Nauman has had good service there too. They didn't say anything about his y-pipe when he took it in.

Funny, they're right down the street from me

bought my ca 2k there, won't go back

they won't care about the mods cuz all they know is "no trouble found" and then explain that is how it is the way the engingees thought it should be! I have had very bad service and for a short time very good service , no in between and the last was back to very Bad! with bad attitude. I have tried VOB and they would not call Nissan corp as they were instructed too, also telling me that they got 41 mpg w/my car when they tested it! good luck!
