dealer will not fix TSB, surprise surprise

I go in for the shifting driver seat and hood rattle tsb on my 2k1 max on friday the 21st. After about 5 hours, they call me back to tell me that they test drove the vehicle and could not duplicate the problem. I ask to drive the car myself to show the service manager, they decline telling me to wait till the problem gets worse that it happens more often, then I can come back and they can test drive it again. Oh, and I forgot to mention that they went through my CD's cause the player was playing a different one before my car went into the service bay. Friggin' nissan...

here's my secret

here's my method to getting anything... (can't believe I'm giving away my secret!):

-use "please" and "thank you" often.
-make it seem like the other person is "going above and beyond" and is "really working hard" (when actually he's just doing his freakin' job).
-be polite, be persistent, and DO NOT LEAVE. If you leave, the other person got what s/he wanted...the problem is now gone.
-be prepared. In this case, have a copy of the TSB with you. Verify first your car is in the range of VINs effected by the issue (and have the range written to show you've checked).
-start at the bottom and work your way up. In this case, if the service manager isn't doing his job, ask to speak to his boss. If possible, do not let him get his boss alone. Ask him to get his boss and follow him, literally walk with him, until his boss shows up. This keeps him from bad-mouthing you as unreasonable before you even get to tell your side.

-But above all, be polite and do NOT leave. If you must leave, go back soon and try again. I can't stress 'polite' enough.

In case you're wondering, I got a new transmission in my old GSX using this method. It siezed just past the warranty and I convinced them to give another one. Then the timing chain went and I got a new one, plus all the work to fix the stuff that was damaged. Then the turbo had a problem and got a new one... all free, all warrantied, all by being polite. It took 2 visits, probably 3 hours each visit, but it was worth not having to pay $5000.

Or...

when you take your car in, you can wear a Polo shirt with the Nissan NA logo and phone number printed on it.

Good ideas, all... but especialy the be polite part. Never loose your cool, and don't sound like you know it all and he's the ingnorant incompetent, even if he is.

I always remember this: the dealer wants the work but they don't want Nissan to say the work was unwarranted and refuse to pay them. If they have any doubts they'll balk so take away all their doubts by having information handy.

Some times, if you haven't pi$$ed the service writer, just letting him know some of your buddies have had the work performed under warranty will help him decide.
