help! racing ticket!
help! racing ticket!
I just got a racing ticket here last nite in STL, missouri. my ticket says "excessive speed from the start - racing" . The funny thing is, I never went over 30 mph, which was the speed limit, and I slowed down a lot to turn into my school's residential area. It was about a block long. Anyway, I am an Illinois resident, does anybody know if my insurance will find out? My court date is next month. I guess my possibilities are to plead guilty or not guilty, so I need some help on what to do and what the possible outcomes are? I'm already talking to a lawyer, since I never exceeded 30 mph, although I was accelerating somewhat next to my friends car, but I stopped after like a second. OKay, thanks guys.
um i got a street racing ticket a while back, in cali you have to go over the speed limit in order for it to be called streetracing, if you dont go past the speedlimit it is unsafe start or excebition of speed. streetracing espicailly when your under 18 heeh you wont be able to get insurance trust me i kno.

Yeah, I've heard you can get ticketed for taking off from a stop, even if you don't exceed the speed limit. It's called "exhibition of acceleration". What BS.
As for interstate insurance, I never leave Texas, so I can't help you there

Fight it. If he was unable to clock you and would be willing to admit that you never broke the speed limit, the ine and points will be either reduced or dropped.
Also, make up a story about having transmission hesitation under heavy acceleration and that flooring it was the only way to test it. And your friend was next to you to help listen to the timing on the shift since you can't hear it in the car.

nad of course no front plate
. my lawyers is gonna blame it on defective hardware since i had my ACT installed the week before "i wasn't use to the clutch and it wasnt broken in."Trevor
As far as your insurance I wouldn't worry about it unless you are going to change insurance companies. The only way your insurance will go up is if the company runs an audit on you. When you get a ticket it only goes on your record, usually for about three years, your insurance company will NOT get notification of this. The only way they will find out is if they look. Audits are run by companies if your trying to get insurance from them, usually when you turn 18, and when you turn 25, or randomly. If you don't tell your insurance and keep your current insurance company, chances are your rates won't go up until you turn 18 or 25.
Like others said if even if you didn't break the speed limit you still can be charged with exhibition of speed. That could be accelerating to fast, screaching your tires, or poping a wheely on a motor cycle.

I would go to court and see if you can get it reduced. It will be a big point ticket.
The last couple of times I moved or changed insurance companies they actually looked back 5 years. Those stupid tickets hang on for a long time.

Innocent. As long as you didn't break traction and didn't go over the speed limit and of course weren't racing another car, the judge should throw this one out. Tell him you have a Nissan Maxima which is a family car
Actually this sucks >>>>
I got a friend that got the same ticket...."racing" even though he wasn't. Basically he has one of the "Sport Compact" cars and his friend has a similar car and they were side by side talking not going over the speed limit. The cop pulled them over and gave them a ticket for "racing" saying that they were side by side, they tried to explain to the cop that they were just talking and not racing, cop said "explain that to the judge" well when court day came they tried to explain it to the judge but the judge would not even listen to them and pronounced them guilty. I hate to say it but we think it was discrimination thing, my friend and his friend are ASIAN, under 25 years of age, have "sport compact cars", the copy was caucasian, the judge was the caucasian. Typical sterotyping in my opinion. He has received 2 other tickets for simlar things and is really thinking of selling his car now and getting a truck, cuz he says that cops just love to follow him, etc.

Re: Re: Actually this sucks >>>>
If he did wrong he would take responsibility but he did nothing wrong, driving right next to someone is that ILLEGAL ??? Also I would not consider my friend a LOAFER, he has a good paying job, he paid for his own car, nothing was given to him by his parents, etc.
I agree with you about the people not taking responsibility for their actions, but there are many people out there that are innocent and are accused of doing things they didn't, happens all the time, but it has been proven that the majority of the people that are innocent and accused of crime they did not commit are minorities. I am not trying to make this thing a minority issue, I am just stating what I read and what happened to my friend.

fst96se: Amen. But it's all too common. And by the way, now those same people will call you racist for making that comment.

Nope, my tires never spun. I didn't even go full throttle, maybe 3/4. and I slowed down in about half a block, becuase I had to make the next right. I didn't have to slow significantly to make my turn either, and the speed limit was 30mph, which i never passed. yes, i pulled ahead of my friend next to me, but i slowed down before reaching the speed limit, and he passed me.

Does your friend have window washer lights? Because I was thinking about it, and if I were a cop I would right dumb people like that every kind of ticket I could.

It has to do more with his car, and his age. Street racers are seen as punks and trouble makers. I get the same thing from the police and I'm white.

Actually his car is totally stock looking stock rims, etc.
I didnt think you can get pulled over for accel fast and not breaking the speed limit. I know that if you pop the tires you can get busted for reckless driving since at that point you have no control over the steering of the car. How can a cop judge how fast you where accel, getting to thirty is still in first gear?!
Here in GA you can get the same ticket. They call it "Excessive test of acceleration".
While asu174's idea is good for an excuse and I probibly would still try to fight it the result could be a higher fine. You'll just have to see what kind of attitude the judge has and take it from there, Hope your not call 1st lol.
As far as Insurance goes you shouldn't have a problem with an out of state ticket. I got popped just south of Tampa doing 112mph 3yrs ago, $295.00 ticket DOH, my Co. didn't find out about it.
Good luck.

What you do is go to court on your date and get an extension. Then come back on your date of reappearence and plead not guilty and fight the ticket. They will set you a court date and send a copy of this to the officer. Then go back in on any day before the date your are to appear in court and tell the judge you are going out of town and you need a new court date for trail on your ticket your fighting. Ask to schedule it earlier that week and with all the confusion going on in the courts and the cop who wrote you the tickets busy schedule, he won't show or be notified in time to be there for court and you ticket will be dismissed. Also chek the ticket for incorrect info(Name , address , liscense # , Anything)anything incorrect and they will have to dismiss the ticket.(I actually have 2 A.K.A.'s due to incorrect spelling of my name on tickets-1 for speeding and the other for stinky green-both dismissed) This info has been received by a law enforcement friend who has had this happen and he told me about it. My only caution is it only works 1 or 2 times @ the same court and then they catch on. Good luck and I also have another remedy but you have to P-M me.
