Got a TICKET in Denville NJ Today HELP!!!

I was on 2nd gear going into 3rd gear going up a hill and the police was just at top of the hill which is flat, he claims he clocked me moving at 54MPH. His car was moving coming down the hill but he was still at the flat point on top of the hill just aobut ready to come down, the speed limit on that street is 30MPH.

For the others that received speeding tickets and fought them can you provide some advise. I have 0 point on my license now, which could be changed if I don't fight this ticket. HELP HELP!!!!

I have no advice for fighting a ticket...I've had bad luck fighting speeding tickets. BUT...Since you have 0 pts, just pay the extra $30 (or so) and go to traffic school. 16 hours of pure boredom but it stays off your DMV record and your insurance company won't know either...as if it never happened. I hear you can even do it online now...not sure how though... Good luck!

Denville cops are known for being real hard a$$es. I clerk for a town nearby Denville (sorry, can't tell you where) and I know we plea almost ALL traffic tickets down. All 4pt tix go to 2pt., and all 2pt. tix go to 0pt. However, the state of NJ only allows this type of plea 2 times. Go to court and talk to the prosecutor. Explain to him that you have 0 pts and have been driving for x many years. Otherwise, invest in an attorney to fight for you.

what kind of advice are you looking for? If you were speeding, you were speeding and you'll have to work the system to your advantage.

Don't expect to get off because the cop car was moving, coming at you, there was a hill, etc. Maybe 15 years ago radar had a hard time with that stuff, but now it's all modernized and moving cop cars can accurately capture speeds in all types of situations.

Was he using a traditional radar gun or a lasar radar gun? I have recieved several tickets in my max all of which were dropped.

54 in a 30

Thats a 4 pointer for sure.

Plead not guilty, go to court and talk to the prosecutor. Normally as advised in a previous post, you'll get it reduced. Expect to walk out of court with a fine and 2 points on your liscense.

Some advise - slow down.

Never said I was going to use those points as an excuse. I know that they have great moving Radar Guns. My point is I was down the hill and there was a car that was in front and one in the back they both had about 2 car lengths in between my one. I did some research and it clearsy states that Radar signal cannot bend corners or go down hill.

I am only looking for advise that people can contribute, which some have. Also I had just made a left turn onto the road and I was just getting out of 2nd going into third up a hill my car has 1300 miles and I don't abuse it, so I cannot figure out how I was doing 54.

Are you from NJ? Do you know if in all counties this is an option. I will take the 16 hour course.

You didn't educate yourself before you were pulled over, so you are already behind the 8ball. When you were pulled over you should have asked the officer what he used to determine your speed, and which band the gun was if he answered with radar. Depending on the band (K, Ka, L) they have different things that will give them inaccurate readings.

..to the advice of the people here to "Slow Down" and "well what do you expect". That is really gonna help this guy out Unfortunately, unlike you (people who never go 1 mph over the limit), the rest of us live in the real world and occasionally drive in accordance with the conditions of the road. I've yet to find the posts that read "Why I bought all these mods and don't go over 55 MPH"

-Anyway-

I'm from NY, but I have had some luck in the past by fighting tickets and talking to the cop to have it plead down. The 2 factors that helped me is that I dressed nice (no jeans or cap) and was polite to the cop when he pulled me over (as much as I wanted to put a bullet in his head).

I've also had luck by postponing the hearing (ie: sick, grandma died, etc. - all BS) and the cop never showed up at the rescheduled one which means you get off scott free!

I don't know if it is the same everywhere, but the towns where I got the tickets you had to enter a plea (arrangement) and then go to trial if it was not guilty. Hence, why it is better for all parties to cop a plea at the first one.

If you do end up getting some points, here is some of what's offered online:

Defensive Driving Courses

In NY, this course I think will take off 4 points. Its a 6 hour course so NJ may be different.

Some advice? - Keep speeding...just don't get caught

I'm in MA, and the way it works here is like this: you request a hearing, and the first hearing is in front of the clerk magistrate. The cop may or may not show up, and they may have one cop there for all of the hearings scheduled that day (it may be a diff cop from the one that pulled you over). Anyhow, you make your case and the cop makes the case (reads the report), and then the clerk makes a decision. Usually, if you're found responsible, they'll offer you to reduce the fine amount (the points on the insurance stay the same, which is the *****y part). However, you have the option of scheduling another hearing, which in this case, would be in front of the judge. IF THE COP WHO PULLED YOU OVER DOES NOT SHOW UP FOR THIS HEARING, CASE DISMISSED NO QUESTIONS ASKED!!! This is the best case alternative. One other thing you can do is request a discovery, which means the police department should submit the police report (the ticket report) and you can request them to tell you what kind of radar gun was used. If it was indeed radar, and not laser, you can make a case that the radar picked up the car in front of you, and not you, but if it's laser, it can pick out one car from a whole bunch w/out a problem. Just come up with some story and sound convincing that there's no way you could've been going that fast, and just sound firm and confident.

If you want help getting out of breaking the law, you should give as much detail as you have... don't make us guess. I was just trying to figure out what you want to use to get out of the ticket... knowing what *not* to do is as helpful as knowing what you can do.

I commented on those points because they were points you brought up and you didn't say if you were going to use them or not... so I recommended "not."

So, here's what you'll find over and over if you search around here:

1. don't speed
2. if you speed, don't get caught
3. if you get caught, plead innocent and
a. beg the prosecutor to lower the penalty
a. ask him to let you plead to a lesser offense
b. ask him to let you take a safe driver class
4. shut up and pay the fine... "did the crime, do the time" kind of thing

Your car can easily to 54 at the top of second. You didn't mention the other 2 cars in the first post. Did you get a license plate on one of them to be a witness?

You can think of a radar gun as a spot light. unless it's pointing in your general direction you will not be in it's beam. Without knowing how the radar module is mounted in the police car and how steep the hill was you were on it's hard to say if he really got you. But you always need to ask to see the gun. If it's mounted in his car and he was moving it should show you both speeds (his and yours). Also remember that Radar guns only display the speed of the "best signal" meaining that if a suburban and I are together on a road, chances are the radar will pick up the signal from the suburban.

As far as getting out of tickets, i've found it's always best to go in to the payment place and say you want to plead not guilty, sometimes they just say, "well our case load is high, if we agree to drop the ticket if you pay the fine will that work?" and you pretend to not want to then say, well ok . Or else go all the way into court. Sometimes just before the case starts the attorney will come over and suggest a compromise (to save himself time) of paying the fine but not having it go on your record. If not then trust the judge to see your good record and see that there may be the possibility of discrepency in the speeding situation.

I apologize if I did not mention the two cars in my first post. I did see the reading on his gun however it only had one reading, I believe that someone posted that you should see two readings if he is using a moving radar gun. I know that there is a 99.9% chance that I did not get up to the 54MPH going from 2nd to 3rd, because when I made the left turn onto the road and I must have went about 1200 feet before I saw him and he saw me. I was driving home this afternoon and I was looking at how I drive and I never, never got up to 50 in 3rd. I did aggressive driving also and I could never get myself to rev the engine that high. I am not saying this is not possible, but my car only has 1350 miles and I baby the car. I also read on the internet that radar guns are not very good when detecting speeds going downhill, because he could have gotten the person behind me. Listen if I was wrong I would not even post this here to ask for help, I would just ***** about it, but not post it here.

I want to try to do anything to get no points. I called a lawyer and he wants $750, and obviously he cannot garantee me that he will have everything dropped and just pay a fine.

Just plea "No Contest" My 88 in a 55 was a $250 fine and 0 points.

I was my understanding that when you plea "no contest" that is as good as saying "I am Guilty"?

His gun has to show his speed too (if he was moving) or else it considers him not moving, thus adding your speed and his speed together.

Some things to note --- in CA (atleast) the cops do NOT have to show you the gun or the reading or anything.
If they think its risky to let you approach the patrol car, they can refuse. So its up to the cops discretion - you cannot use that as a defense.

Also, most modern radar guns can display 2 target speeds ( multi-headed ) - the strongest ( as in the largest vehicle in the beam ) **and** the fastest - so a small car cannot hide around larger vehicles -- this is a real killer.
