So I tell the dealer there's an intermittent hesitation/lack of power around 3K RPM (there is) and could they please apply the TSB for it. They test drive it 30 miles and when I go to pick it up they say "We couldn't duplicate it." Lousy dealer. Looks like they've lost my business.

Sad but true you always have to act a fool to get things done half way right. I've always left nissan service in a hail of heated vocal exchange.

Don't pay them crap! Go somewhere else and let them know you're going to rip the other dealer on the customer satisfaction survey. They test drove it 30 MILES? Holy crap...I'd let them have it for that. That's ridiculous.

I think I might try this next time. The car's gotta go in soon for the damn hood rattle, so maybe I can get the ECU update with a little help from Krispy Kreme.

The particular TSB being discussed here is for hesitation. Short description is drive steadily at 2k-3k rpm (can't remember exactly, I didn't have this problem), then fairly quickly push the throttle (don't floor it). Car will stumble for a second or two.
It should be covered under your warranty (assuming you're still in warranty, since you bought at 18k), and it's unlikely it was done before you bought it. This TSB came out something like two months ago.
There's also the theory that this TSB will cure the throttle lag problem of the drive-by-wire throttle (throttle doesn't respond instantly to 1/3 or more gas pedal from a stop). I'm on the fence on this one; the ECU flash didn't fix mine for good, but flushing the ECU memory and advancing the timing did.
