Cruise Control problem

The cruise control on the old Maxima is playing up. When the temperature is cold pressing the cancel button on the steering wheel won't disengage it. Press the foot brake and it does (thankfully). In warm weather it never does it. Anyone with ideas? (BTW - This is an Auto)
