I don't mean to totally come down on all the suggestions so far, but you guys need to learn a little more about your insurance. Comprehensive insurance covers anything "Other Than a Collision". It has absolutely NOTHING to do with this situation. Read your contracts.

Now in general, insurance follows the vehicle, NOT the driver. The owner of the car should have some insurance, and that would be the insurance to go after.

If the driver can't afford to get licensed, get his own car, let alone his own insurance, then I'm sure he has no asset's, no money, nothing. I doubt his future wages are even worth garnishing.

If the owner has no insurance, sue him personally, he is liable as the owner of the car. The police department should indicate who the owner has insurance with on the police report. IF they don't indicate who that is on the report, then call the police department and ask them to find out. They can contact the owner and get that info.

I hope this information helps.

Oh yea, get that thing home asap. "F" those fee's.

+1, glad your ok, been there done that with no licensed unisured drivers good luck trying to get any future wages aoutta him, atleast there is an owner to go after.

hey man glad to hear your ok physically...I've had my 98 Max since Sept of 99 and in June of 2000 i was in a hit and run. A women in a Caravan blew stop sign and pounded my passenger side quarter panel. I was flipping cause she took off and i was stuck with the messed up car. However because she was an inconsiderate BEOTCH and had no respect for other peoples live's when on the road, god helped me out....Her front license plate fell off and I got more than what i should have...However, it doesnt matter of the person is a legal driver in any state or has insurance or not...The car should be insured, i mean in NJ it's the law to have insurance and a motor vehicle and I'm pretty sure it's the same everywhere. So get the plate number, go to the police, get in touch with the owner and take it from there. The prob with suing is that your gonna spend a lot of $$$ doing it. Lawyer and all that adds up. So see if State Farm will go after whatever the car that hit you had. And hopefully get 5k...Don't forget. No matter how hot the 4th Gen is...It's an old lady and isn't on too much Value these days....if i was in your position i would either get a 07 Acura TL or 07 G35 4-door...want the M but too much money...but if you can't afford that def go with 2003 Max...def my fav...the 6th gen sucks

Thanks for all your suggestions.....
The police said, the owner moved..... so did the sheriff's office. They just quited on this case by giving me a BS like that. The owner has insurance or not, that we won't be able to know.
The dirver is an illegal mexican. Although the garnishment was served about two weeks ago, today I got a letter from the court saying that the restaurant denied that guy is a employee there. So I guess I am out of my luck.....
I think I should go down to his apartment and deal with this myself.....

Ummm I'm not too sure "peace keeping" was what he had in mind... I know it wouldn't be on mine!

This "illegal" has absolutely no reason to take any responsibilty... New social security number, new place & new job easy as pie. Meanwhile, he's left holding the bag.

This is yet another one of those "valuable contributions" from an "undocumented immigrant" that politicians are constantly trying to shove down our throats.


It totally sucks. I feel really bad for you dude.

Wow that sucks man!! I know if i got in an accident and someone so stupid to drive drunk and with no license..id be the one in the back of the police car..gotta take those stupid SOB's off the road before they severly injure/kill someone innocent. Seriously i cant stand that first of all driving with no license is stupid in the first place, but drunk i dont know thats just to far. Id freakin bust out the 3FT crowbar in my backseat and put it to a use. LOL i just about used it when some guy swung open his door and nailed the side of my car WHILE i was in it..i told him to watch the **** out and he said "who ****in cares its a POS" No sorry's or anything, basically told me to **** off.. Needless to say..after a small argument..he left the parking lot with "several" dents and broken windows .

I posted an ad on craigslist, but all replied were scammers. Some even asked me the mechanical conditions of this car, and one told me his wife needs the car very soon to drive to work.

I will put one up here in the classified session, if still no one is interested, I will get the parts that I could take off without heavy tools and that I know what that is for sale, then throw the whole thing to junkyard.

I don't have much time to part it out myself plus I have limited knowledge about parts. No offence, but it's a bit easier for me if I sell it whole....

Good thing you are OK. Some HS grad just died here in WA State from a multiple repeat offender. The drunk lady was going over 100MPH in her Yukon the wrong way down I-5 when she hit this S-10 head on killing the pass and critically injuring the driver.

No worries though, she'll be out in no time. She also had no DL or insurance.

Anyway, you better bring a posse if you are going down there to face off with vato. They don't play nice or fair, you'll have to deal with the whole lot of 'em, so be prepared.

STILLENGLE, your right. 2 wrongs don't make a right. But leaving a wrong alone won't prevent further wrongs from being done. You can put your tail between your legs and be a victim, or you can do something about it. People repeat offend because there is no consequences. That being said, I wish the legal system would do something effective, but it won't. heck, if the OP retaliated against the illegal, the system would prob come down harder on the OP than the illegal. Isn't that just wonderful??

yeah i hear you man, i was just curious. i hate my steelies and hubcaps so if you feel like/can get the wheels off it and still get rid of her lemme know, cuz i'll deff take them off your hands
