1995 Nissan Maxima SE insurance issue
I posted a thread on September 18 entitled Potential Problem with ICBC. ICBC is the provincial insurance company in British Columbia.
Someone backed into me as I was exiting a parking lot. I have collision coverage on the vehicle but the other driver was deemed at fault.
Some time pre-Covid the insurance company no longer looked at the vehicles and provided their estimate. They changed it to the owner
taking a recognized body shop on their list. The body shop then provides the insurance company with pictures and their estimate.
The estimate came to Cdn$3,366 (about US$2,525 at current exchange rates). I am having trouble attaching pictures which show the
damage and pictures taken at the shop from various angles, the interior and the engine bay which were sent to ICBC,
The estimate included Cdn$395 for a door from an auto wrecker, the last onc currently for sale in the province.
It is more economical to replace the door than fix it. The damage is to the right rear door, a bit on the rocker panel below it and a bit of the quarter
panel. The estimate includes painting the replacement rer door, blending paint into the passenger door (front) which is not damaged, repairing the
quarter panel and painting it. Clear coat then goes on top.
What I am looking for is an opinion on what peeps here think the car is worth. Normally I have to take their offer and they take the car.
The woman is trying to work with me so I can keep the car and get it fixed which is what I want to do.
I have owned this car since day 1. It has 115,814 miles on it. Rustproofed, leather protected and Diamond Coated the day before I picked it up.
The car has been detailed numerous times, leather protected annually. The back seats look like they have never been sat on, the front are in
very good condition. The colour is DJ2, Black Emerald, and was fairly rare I believe
I ordered the car through an auto broker and it took me more than 3 months to get it. It came with every option. Leather, sunroof, Bose, AC,
cold weather package front seats are heated), security & convenience package, ABS brakes, Nissan plastic sun roof wind deflector). The car s
built for the Canadian market and has limited-slip differential.
I ordered it with a 5-speed manual transmission. I got the infamous dreaded differential carrier bearing leak and just added gear oil for some time and ended up
getting the transmission rebuilt (new bearing and seals) less than 37,000 miles ago. Since the transmission was out I decided to replace the
clutch kit even though it had an estimated 50% to go. Replace with a LUK clutch kit complete with pressure plate and 4-wheel alignment
The car is stock. It has an FSTB and a K&N panel filter.
The woman is prepared to give me something for the trailer hitch for my bikes nd rebuilt transmission. I sent her invoices yesterday.
i am allowed to send her comparables within two years of my car. The way things are going I will still be out of pocket to repair the car.
They only consider maintenance done in the last few months. An employee of the insurance company does not even look at the car
to consider its condition.
I haven't had to spend any money on the car this year. All it needs is an oil change.
I have a list of repairs for the past 5 years (2015 - 2019) and she doesn't even want to see it.
New BF Goodrich Traction TA tires (11,000 miles ago), new front brakes & outer CV boots (16,000 miles), new hood shocks, AC recharge, 1 year old AC Delco battery,
and the list goes on.
The car runs as well as the day I got ity. She wont come up with a decent comparable because one doesn't exist unless it was just painted and somehow it had no rust and seats have been replaced.
I haven't told her about the Budget stainless steel y-pipe I added a number of years ago. That wouldn't go over well with them.
I know it is hard without pictures but assuming the car wasn't smacked up, any idea what it is worth.
I hope to get it repaired rather than written off. The shop I am working with has an excellent reputation.
I have been on this site for over 16 years but not that much recently.
I told the woman that my car is higher in demand because it has a 5-speed transmission.
She didn't buy that. I said young drivers like this vehicle because of the 5-speed and its power. She said most young people don't know how to drive a manual transmission. Go figure.
She didn't deduct for the manual transmission.

It doesn’t matter what we think you’re car is worth. The insurance company will offer you market value, which isn’t much for your car. You can try and fight for a higher value but that’s your call. If you like your car (and it seems like you do) just fix it on your own and move on. Buy a cheap second vehicle for a daily driver so you can preserve your glorious maxima.
What's is worth depends on location and condition. Being that you're in BC, it's going to be hard for us US citizens to really help you.
All your maintenance receipts mean diddly squat to the insurance company. They are maintenance receipts....maintenance items and repairs are things you are supposed to do to keep a car running right. Find the lowest mileage clean example you can find in BC and add $1,000. That's about all you can do.
Your car is 25 years old now, and is not is demand by any means. 5spd or not. Only you will love your Max as much as you do.

I am going to get it fixed if I can and am prepared to pay the difference. I am lucky I have a representative that is fighting to let me do that. Just trying to up the offer a bit.
She is only willing to see comparables up to two provinces away and up to two years age difference.
I found one in Alberta I sent her yesterday that I found on Kijiji. It had rust on two quarter panels. The guy had two quarter panels he was throwing in.which would need to be installed and painted. The car was lower mileage by about 18k, plain Jane, no leather seats, had AC, Bose, sunroof, asking Cdn $4,700 which is ridiculous.
Didn't say anything about cold weather package or security & convenience package.

The provincial insurance company is letting me keep the car and get it fixed. It is going to cost me Cdn$1,200 (US$900) to get it fixed out of my own pocket on top of what they are offering me.
They have their own system and their supposed comparable was a 96 SE automatic with 25,000 more miles on it than mine and wasn't in as good of shape as mine..
They are also not slapping a salvage or rebuilt title on the car.
I am planning on buying a car next year for my 70th birthday. Not new, say 2018 or 2019, low mileage.
Alternatively, there is a car that just hit the market where I live that i might take a look at, a 2009 Infiniti G37S sport with only 33,000 miles on it.
I will keep the Maxima and put collector plates on it.
I may offer it for sale at some point in time if I can figure out how to post pictures..
