Dealer lied to me about warranty ?!?!?

I was reading the stickies i came across a section where someone posted that under the Bumper to Bumper 3yr/36k mile warranty our front rotors are covered, My rotors on my 03 w/17k on the car are warped and Heat cracked, i went to the dealer and he said its wear and tear and nothing he can do. He said i would have to pay to get them changed i dont mind paying its just that if its covered i shouldnt have to pay. . What can I do can i get proof that its covered ? Thank You.

Knowledge is power. The dealer gets paid more for non-warranty fixes. So it's you against him. You will have to thoughly read the warranty and battle him on his own terms.

Dealers will often say "it's not covered, or nothing I can do" in order to drum up more business.

Don't you have a copy of the warranty? Or you just don't want to go though the trouble of reading it?

IIRC, rotors are only covered only for the 1st year or 12k miles.

I work as a Nissan Salesman in Hawaii. The Rotors are not covered with 17k miles on it. Almost everything mechanical and electrical are covered under the basic 3yr 36,000( Except wear and tear items). The Dealer did not lye to you. Also with your Maxima you should have a 5yr. 60,000 mile powertrain warranty. Rotors are not covered under the powertrain. If you guys have any questions on warranties or other dealer related topics feel free to email me and I'll do my best to answer your concerns. jared96781@yahoo.com

Whether they have to fix them or not, many will. I had mine turned 2x with over 20,000 on the clock. I was a good customer with them, went there for maintenance and bought a different car from them. Depends on the dealer, if you have another close dealer, try them.

My $.02. I think your best bet is to call the 800-NISSAN # (whatever the rest of it is). I personally know 1 person who had the car regularly serviced and ran into a similar situation with their brakes. Nissan USA paid to have the brakes replaced.

However, having said all this I think it would be hard to prove the brakes defective. I'm not completely surprised that you had to turn them twice. Several board members have reported similar problems. Since other people, myself included, have not had this problem you could argue there is something defective about your particular setup (caliper or rotor). But likely the dealer will argue that you are simply hard on your brakes.

Print out the Brake Judder TSB. It says its for 00-01 but it also says that the rotors are covered for 3yr/36k

2 things:

1) What they SAY is in the warranty doesn't mean shat.
2) Only what is WRITTEN in the warranty counts

And since you couldn't even find the warranty, how can you complain?

It's crappy that they lie to you but it's equally irresponsible of you not to check the warrant carefully.

CSI means a lot to dealerships.. you can shat on them if you like.. that is messed up that they dont wanna cover it.. if you can help them wit the Csi then they may help you out wit the warranty on the rotors.. i work at a Honda Dealer.. ive seen rotors get resurfaced 2-3 times for free.. becuz the car had less then 36k.. but then again.. my shop always try to help these customers.. cuz us Techs need the extra Csi bonus..

depends on the relationship with the dealer as well. my rotors were warped @ 8k miles and they replaced both front rotors and pads. then they warped @ 20k and they cut and left the same pads on. finally @ 32k, they could not cut them again so they replaced the rotors. the tech showed me the pads and had plenty of life so i decided to leave them be. all of this work was done for no charge. i had an extended warranty on the car but they did not know that at the time and no claim went against it. i also had the car repainted for no cost but that was going through NNA for almost 3 months but that is another story. in my case, it depends on the relationship with the dealer.

Yup...

Always push-back and make every head "uncomfortable" in the process if you are "right." If not, suck it up, pay the cash and move on. If it's it's a sincere deficiency my tactic is to always make Corp burn the dollars to deal with me at a minimum. If it's legit/debatable be a reasonable consumer (common sense should prevail on both sides) and make the appropriate decision (e.g. be straight and pay when you should, but...push hard when you are in doubt after reasonable research).

Assuming your [biased-not a criticism] post is accurate; "03 w/17k on the car are warped and Heat cracked" no way I would accept a "go away' response regardless of what's on paper. Bottom line is GP% on an event, business is business whether it's $2.00, $2B+ bucks or more. If you are right, push the equation, if you are wrong, don't. If it's a gray zone, state that (customer sat chaos), document it, fix your product (car in this case) and on the next spin, come back with a vengeance well-armed.

Net- Never let business controls, process, [insert your corp s*** here] screw you when there is reasonable doubt.

What are you going to do?

True That about the survey's! Any dealership can do what ever they want as far as fixing none warrantable repairs. But Nissan won't warranty it! If the dealership fixes it....Its coming out of the dealership's own pocket not Nissan! We do it time and time again to keep our cust happy and get better CSI scores. But remember...They are not required to fix something for free if its ot warranted! Nissan is real strict about this matter.
