AEM Air Bypass, with Injen CAI

Some people have said that the Injen CAI may risk water intake. Would this product from AEM be the way around that?

I'm not entirely sure how it works. Obviously when the main filter is full of water it will allow air to flow through. But how does that work? Is there some sort of valve that opens at a certain air pressure differential?
