Need help guys with a traffic ticket.

Need help guys with a traffic ticket.

This is kinda long.

About 6 months ago I recieved this letter from the Maniciple Service Bearu Collection agency for the City of Temple in Texas.
It said that I owed 475 dollars becaused of a 10-14 mile per hour ticket, and failure to appear in court.

So that's when the phone calls started.
I told them that I didin't recieve a ticket from the city of Temple.

I did not revieve a ticket from the City of Temple.
They kept saying I did.
I asked them to mail the ticket to me and if it was me and all that etc.. I would find a means to take care of it.

They never sent me a ticket.
I got so tired of the harrassing calls, that I let my parents take care of it.

My brother went to the city of temple today.

On the ticket it says that I recieved a ticket on May 22, 2001, I was a white male driver driving a silver 4 door nissan. It had my drivers liscence number, my plate numbers, and my signature on that ticket.

I was never in Temple or around Temple on May 22, 2001. I was working my intern job in dallas that Started on May 20, 2001.
I have proof from my University that I started my intern job on the 20th and that I quit on May 24, 2002.

So it's very strange.
I don't know what to do.
There is no way that I was in Temple at that time.
That is 4 hours away from my house.

Please help me out.

OMG... a 'get out of this ticket' question with facts and evidence!!! Cool!

Plead not guilty and get a lawyer. The prosecutor is going to say it's your ID, car, etc so it was you. Here are some questions you need to answer:

-Does the signature even closely match your handwriting?
-Are you white male (yongjun...guessing no but figured I'd ask)?
-When was the last time you ran a credit report?
-Did someone steal your identity?
-Do you own a silver Max or did you have the SuperBlack then?
-How do you think your license plate number, ID number, and signature got there?

Again, the prosecutor is going to say it was you and the cop got the colors (car and you) wrong. He's going to use the signature, license, and tags to 'prove' it was you.

Did the ticket have an address on it? How does Texas work...can you request to see how many licenses have been issued to you? If the license and picture are stored digitally you may be able to show someone used your info to get a duplicate ID.

Hey YJ I would talk to d_warner. He is (I believe) a city police officer from Huntsville, TX who is very knowledgable on citations and regulations. He drives a 5th gen and would probably know the course of action require to dismiss your ticket.

Here are some questions you need to answer:

-Does the signature even closely match your handwriting? Funny thing is my brother got a ticket in April 2001 in the city of Temple going to austin. He paid and got that ticket taken care of. We have very similar names and signatures. His name is Yong W. Lim and mine is Yong Jun Lim. Our signatures are very very similar.

-Are you white male (yongjun...guessing no but figured I'd ask)? Nope

-When was the last time you ran a credit report? Last week. Perfect credit history.

-Did someone steal your identity? I don't know and that's what we are figuring out.
-Do you own a silver Max or did you have the SuperBlack then? Then I had a 2000 Grey Lustre maxima looks black at night.

-How do you think your license plate number, ID number, and signature got there? Have no clue. But we are going to find out.

How did they get my address? The collection agency found other means of finding it. The other thing that is wierd is that my drivers liscence doesn't expire to 2005 and It has my old address on there. I now live in a new city. So I don't know how or what got this thing started.

Another new update.

The ticket also said that I have blue eyes and that I am 4 ft 8 inches tall.

I have brown eyes, and I am 6 ft 1 inches tall...


I will keep you guys updated.

Man i just hate this ticket crap...I mean there is nothing more frustrating than dealing with tickets....damn...I hope you solve this thing smoothly...

OK, to me this is pure 100% Phooey Baa Baa Stinky. I can give the officer some leway (sp?) on the white part. Some "ethnic" features are predominant in people and sometimes they are not. Not meeting yongjun I could not make and assumption either way.

But how would you explain 6'1" versus 4'8" in a court of law? I know he might not have left the vehicle, but a 4'8" person is going to be pretty dog gone close to the wheel while a 6'1" person is going to be a bit farther away. Also eye color? My genetics is failing me here, please correct me if I am wrong, but isnt blue eyes a rarity in this case? I am also going to guess that your brother is of similiar height?

Also I have never EVER heard a gray luster called Silver. Gray, black gray, dark gray, black....but not silver.

BTW, I hope to not have offended anybody. Sometimes when you talk about different cultures, its hard to determine what is sensitive and what is not.

OK. Here's the deal. Lets see if we can get this takencare of. First off, If you are 100% sure you didn't get a ticket from the Temple Police Dept, then plead not guilty. It's obvious. If you didn't do it, then you didn't do it. Second, request a trial by jury not a trial by judge. The great thing about this is the fact that in a municipal court trial by jury, the jury also does the sentencing phase. This means that if you are found guilty for some reason, the jury also has the ability to charge you a fine less than what the maximum penalty is. This is great considering the judge will almost always set the maximum fine ammount. Third, check and see if the officer whom wrote you the citation was using his (ICVS) in-car video system. As of september first 2001 all departments within the state are required to either video all traffic stops or document in writing details of the stop. This particularly applies to the race of the driver in an attempt to cut down on racial profiling. If ICVS was being used, you need to find out how to subpeona that copy of the video or get a copy from the deaprtment. If the officer did not properly document his stop in writing, or his ICVS was not working properly, then you may be able to beat the ticket that way. Fourth, do a credit check and see if anyone has been using your identity. If you have ever bought anything off of the net and so on, this is a possiblity. You're license plate would also not be hard to duplicate either if you have failed to delete it from any pics on your webpage or sig. Fifth, there are plates that have been duplicately registered in the state of Texas. It is not uncommon at all to come across a plate that is registered to a Ford truck and a Chevy passenger car at the same time. On license plates now, a social security number is also provided along with the registration. This makes it easier for us (cops) to check criminal histories on drivers of vehicles prior to making a stop. IE, if I see a vehicle matching a description of a robbery suspect vehicle, I can run the plate and then run a criminal history on the driver without ever stopping the vehicle. If the driver has a violent history, I can wait til another officer gets near by before making the stop for officer safety. This feature also makes it easier for someone with connections to steal your information. You need to see if your vehicle has a duplicate registration. Fifth, if you were working in Dallas on that date, then at the least get a note from your employer at that time. If at all possible, get that person to go to court with you. The more witnesses in your favor, the better, especially in a jury trial. Sixth, go over the ticket in detail. I know our citations include the following: DL/ID number, state, date, time, race, sex, date of birth, social security number, last name, first name, middle initial, present address, permanent address, home phone, work phone, other phone, violation(s) charged, direction of travel, lane, location of violation, alleged speed, speed limit, weather, road condition, traffic condition, year of vehicle, make, model, color, state of registration, plate number, addditional information, officer, i.d. Number, and then a place for your signature. Go over this in detail. Anything that looks suspicious, it probably is. Check the signature. If its your signature without a doubt, then its gonna be hard to beat. The ticket is usually signed in front of the officer. Seventh, get legal advice. Get a copy of the actual complaint from the municipal court in Temple. This will probably be a question that the judge will ask you. If you show up at court without doing any research, then they'll try to make you look like an ***.

Oh Damn. I forgot. This should have been number one. How was the speed determined? Did the officer pace you, use stationary radar, moving radar, or laser? This you need to find out. I hate to bring this up b/c it may bight me in the a$$ as well. If the officer was using radar, ask him "Officer.... How did you determine my speed?" If he says radar, then ask "Officer..... Are you Radar Certified?" He may be, but if he is not, you can get the ticket dismissed. Due to the fact that he is not certified to use that instrument. He may try to say, I have been properly trained in the usage of the radar. That does not fly. Also try this.. Ask him if he calibrated the radar prior to begining his shift? If he says yes, then he's lying. You can test a radar for accuracy prior to a shift by using tuning forks, and he has to do this at the beginning of each shift. Ask that as well. But a radar can only be calibrated using very sophisticated equipment. If you can trip him up on the stand, then you might be able to beat his credibility. so...

1 how did you determine my speed (radar)
2 what is the range of the radar (line of sight)
3 what is the effective range of the radar (i think about 2/10th of a mile)
4 were you moving or stationary?
5 ARE YOU RADAR CERTIFIED?
6 did you calibrate the radar prior to you shift?
7 did you test the accuracy of the radar prior to the shift?

Wow thank you so much.
I will pass this along ot my attorney today when I meet him.

Also the signature on the ticket is very very very similar to mine but he looped the L in my last name and I rarely do that, the only time is when I'm in a big hurry.

well youngjun hope everything works out for u....

it happened to me once like that but we were able to disapprove that it wasn't my ticket b 4 we got in to far...
