I know Ferrari has had the "black box" for years. I once was told that Ferrari uses it during every routine maintenance to tell if the car has been driven "properly". I guess Ferrari expected a person to wind out the engine every once in while.
With Evo's, the whole thing was not a black box. When the Evo came out and owners were racing them, Mitsu put out a statement saying that if cars showed "signs of racing" the warranty would be voided. By "signs" they refered to premature tire and clutch wear. I guess there was a few people that took there car in under warranty claiming the clutch was slipping or the tires were wearing.

as for this black box crap the only thing i would worry about if the feds knowing where i am at at all times, this country is becomming less and less free all the time and its really pissing me the **** off!
if any car had this crap that the feds can track at all time it should be yanked out and shipped to their asses if they want to follow it so badly they can just sit there and watch the box with their own eyues, no prying no border line rights stupid stuff.

Don't you think the OEM's already thought about ambitious owners tying to disable or unplug EDR's? More than likely they are/will be integrated into the engine computer, i.e. hardwired onto the motherboard. This just makes sense because all OBD2 ecu's already have datalogging capability for engine diagnostic purposes.

Haven't read the whole thread so maybe this has been addressed, but EDRs have definitely been in use by companies to show abuse by logging things like:
- Hitting the rev limiter
- Exceeding a certain speed
- Deactivating traction/stability control
- Causing traction/stability control to step in
- Activating launch assist
..and other such things. As has been said, BMW also uses it in their M cars to make sure you haven't been beating on them during break-in (e.g. their EDRs can also log when you exceed a certain RPM).
Key Point: They're only actually tracking 10-20 seconds' worth of stuff, but they can still store a lot of events when triggered to do so. So, unless you crash into something at the end of a run, it's not as if they can tell you exactly what you were doing at the track. All they can know is that you hit the rev limiter a few times and exceeded a certain speed once or twice.
I still think mandatory EDRs are Satan for slippery-slope reasons, but I wanted to make sure this was clear FWIW.
