it's a copy of the damn key man..what do you expect? They always work but takes some time to break in. Gently wiggle it around until you get it to work..it will.

consider bringing it back to the guy who cut the key...perhaps he's a lock smith or a person who actually knows a lot more about locks and keys?

Maybe if the old key is all rounded off and worn, the locks have gotten used to this? Maybe try taking it back and get them to round the edges off a bit more with that wire wheel you see on the cutting machine. It probably beats trying to replace it.

Does anyone know if you can get an original factory key from a nissan dealership?

Keys

Bring the VIN number into a dealership, they should be able to cut it from that. They did for me, however it doesn't work in my trunk...

As a key gets older, it gets worn down and tends to work less reliably. A copy of the worn key may not work at all (as you found out). This problem occurs a lot with Max's.

There is usually a key code in the glove compartment that the dealer can cut a new key from. They usually work OK.

well when i bought the car it came with like 4 keys, the one that wasn't the most worn down, which visually looks new, was the one that i used to copy. it worked perfectly where as the copy did not. pretty strange if you ask me

Yup, they cost about $5 each and make sure they say Nissan on them! Sometimes they'll try to sell you a cheapy without the black plastic end.
