yeah your right. my wreck was a little worse then his. dang f350, cost bout 2400 with tailights and realign the trunk, and new bumper... n it was the pearl white which is hard as hell to match... but insurance paid so no biggie... n yeah i had the pannel cut n replaced... couldnt really tell sept the paint

... IDK man. You probablly would have been a lot better off just missing class or being late to work to file the accident report the day you found it. I would take it around to several different shops. Find the highest and the cheapest estimate. Then, take the papers of the high estimate, try and make her pay the full amount, if not then just get your half, and pony up the difference to get it fixed at the low estimate shop. Or keep it for that matter.

Sucks but although you might have a case in Small Claims, if you lose not only are you stuck with your car damage but court cost which, in my experience, can be upwards of a couple hundred dollars.

The marks on her bumper weren't caused by this accident. there's no sharp edges on the Maxima to have caused the plastic to be cut and gouged like it is.

part of that goes to show that she's backed into a LOT of things...

but not going to help you much to PROVE it was her car.
the fact the dent looks like it came from her truck makes it easier, but doesn't prove it WAS her car. coulda been another suburban that did it- not hers.


But it's pretty damn obvious that it was her that did it. add up the shape of the dent, marks on the car, shape of her bumper, location of car in relation to her driveway.... it makes it obvious.

now if there was gold paint stuck in her bumper, diff story. no doubt at all it was her car then...

either way, it's pretty easy to show "more probable than not" that it was her vehicle that did it. that's all you need in small claims- 51%. not 99.9% like in criminal courts.

get a few estimates prepared, then write a letter to her stating that you have sufficient proof that it was her vehicle that did the damage and ask her to pay it. If she does not pay within 30 days upon receipt of the letter (send it certified mail w/ return receipt so you have proof she got it), then you will file suit in small claims court for the damages + court costs.
