Sorry for your loss. i feel your pain. The same thing happened to my Max about 5 years ago.

Sorry about your loss, I know how you feel... My 97 Maxima was totaled back in mid-May. A drunk lady driver pulled out in front of me out of no-where! I was traveling like almost 40mph (I was accelerating after being at a stoplight) then I stepped on my brakes... and I skid for like 15 feet before we collided. It was semi-dark, I had my headlights on though...

I couldn't believe it when it happened. I sat there for a minute or two in shock. No airbags came out. Talk about traumatic incident, I couldn't sleep well for a few days. Luckily there was a lot of witnesses, two girls were sitting across the street outside a house and they witnessed everything and they rushed to my aid. The drunk lady tried to flee the scene of the accident! But cops came rather quick. I didn't know she was intoxicated until 10 mins or so later I saw them putting her in handcuffs and I asked one of the paramedics checking me out whats happening to her? and he said 'DUI'.

Long story short, the drunk lady had insurance and they compensated me for my totaled 97 Maxima which had 110k miles. So I turned around and got a 99 Maxima with a few more miles on it (150k) but it came with a nice upgraded sound system from CarToys. This 99 Maxima actually runs better (quieter) than my 97 Maxima (which I bought used as well). Probably because I was getting 'regular' oil changes on it rather than synthetic! I now know the importance of using synthetic oil for my high-mileage Maxima. It really does make a world of difference.

Well she'll probably be fined out the *** and her insurance probably wont cover the damage to her vehicle. That happened to someone I know that had a 3.5 altima. he wrecked into a car while he was drunk and his insurance only payed for the other car even though he had full coverage.. so he's stuck paying for a car sitting in a junkyard

Yeah I hope she is paying for it, she ruined my life there for a while. I was a whole month without a car... although her insurance did supply me with a rental car for a week.

Here's some pics of my totaled 97 Maxima... and the last pic is of my newly used 99 Maxima.









So yeah it feels like I got my old 97 Maxima back now, except it has a black paint job and black leather seats. Whew it sure gets hot in there though! But it'll be good for winter. It also has seat warmers... something my 97 Maxima didn't have.

Make sure they pay for all OEM Nissan parts. None of that knock off crap. As well as alignments, balancing of new tire/wheels. I would also think about demanding a whole new paint job to ensure it matchs. Make them pay...

Also where did they get it fixed at? Up here we have control of what shops fix our cars in insurance cases. You can probably still sue her...

Make sure you figure out your legal options before you accept the car back. If they didn't tell you that they were going to fix it I don't think you have to accept the car back. If you do accept the car, they its passive acceptance of the terms. Furthermore, did they show you multiple estimates on the damages? This honestly sounds like they are trying to scam you.

Just looking at the one image you have multiple panels that need to be replaced, suspension components, rear axle. Not counting new rotors/calipers/pads for the rears as it is not safe to replace only one side. All and all a couple of thousands of dollars in damage not counting paint or labor. I don't know what KBB is on your max but I doubt mines over like 4k if I'm lucky.

Good God what a ripoff you should really be careful what you say to them and what you sign and whatever before you accept the car back to see your alternative options. Insurance companies like to use your words against you and so you need to think about what you say to not accidentally accept something you later find out what a bad idea.

Well my girl call them asking why wasn't i given a choice of body shop? now they are saying the phone call was a mistake my car is totaled, and i will be getting a check for $4,500

oh well, rip max, at least u OK bro

but like someone said earlier, might be a blessing in disguise,
i had a beatup 92 lude before an idiot truck driver backed up on my car while i was at the bank. came back out and his truck was sitting on top of my hood lol

declared totalled by the insurance; they cut me a check for a g and i got my 98 max, best thing that could've happened to me; thank you idiot truck driver

i do miss the lude tho... so lite and fast

Ok the final out come is that they are going to give me 4,494 and i have rental car till july 22 and they are considering the 700 for my rims.<<(praying they accept that).

With 2010 around the corner i am looking for are a 2000 and up car i.e maxima infinity or acura wish me luck and thanks to all.

Her insurance was with encompass they treated me very well except i wanted the full money for my rims.

After seeing so many friends with DUI's not being able to drive for a year+, I never have more than a beer if I'm driving.... I still don't understand why people get sloshed and drive.

i'm starting to feel the same way i drink but now after this i'm slowing down or getting in car with designated driver.
